What would you all do?
We just bought my wife a new 05 Mazda Tribute on Saturday, 7-2. Salesman informed us that the Tribute came with a 4/50K mile bumper-to-bumper warranty plus a 5 Yr. 100K POwertrain warranty included. We asked him if this was an additional cost or anything and he stated it was no additional cost, included with vehicle. We questioned him about this 5Yr/100K warranty 3-4 times and every time he stated it was included in with the vehicle. This was a very strong selling point to us, I love the 4/50 warranty, but this was great.
Well come to find out, the 5 Yr/100K warranty was for Certified Used vehicles. The salesman has admitted he was incorrect for stating this and a sales manager has apologized as well.
They have offered to sell us the 5Yr/100K warranty at their cost for $795. We told them no way we were paying additional money for something we were told was included. We are trying to get at least some additional accessories out of them. I've even thought about going as far as putting a stop payment on the check until this is resolved. We put over $10000 down and financed the rest thru Mazda to get the $1000 additional rebate.
Just wondering what you all would do in this case. This does not leave a very good taste in my mouth for my first Mazda vehicle.

I agree with the above. They should honor what they said, and if they do not, I would stop payment.

Return with the vehicle and ask to cancel the contract and return your money.
If they wont, have them call 1-800-222-5500 and discuss the deal with Mazdas US customer relations department.
If no results, call a lawyer for legal advice. I know for Oklahoma you have three working days to have buyers remorse and decide you dont want a major purchase (over a certain dollar amount), Missouri may be different.

I would say unless you have it in writing the best you can do would be try and get something extra from them or return the vehcile. Or tell them you will give them one more chance to make the deal right or you will call Mazada directly and then the MO Attn. Generals for consumer fraud. Best of luck. I am going thur a similar situation with my truck(ie..things promised, some in writing)

If you don't have the warranty terms in writing you have no legal avenue. The lesson if that is the case is "Buyer Beware". If you have it in writing call the attorney at 0759 tomorrow morning. If you still have enough time to stop the payment on the check I would do that immediately to show them just how serious you are. You can always write another check if they make the deal right. Not to knock TripleNickle, but if you wait too long your recourse options will dry up. You must be extremely diligent to protect yourself.

Mazda is notorious for trying to weasel out of things. Had a Mazda 323 GT back in the 80's. Computer kept crapping out on it. They refused to fix it, stating they couldn't find anything wrong with it. I asked if they'd put a new computer module in it to test it? Nope. Too expensive. After a month of being a pain in the backside to corporate (I called every stinking day), they finally relented and swapped out the module. Car worked fine after that. First and last time I'll own a Mazda.

Personally, I think the guy made an honest mistake, but since what they sold you isn't what you got, they sould be willing to unwind the the deal and take the vehicle back if that is what you want.

The guy could've made a mistake and then again, maybe not. The bad dealings with a few spoiled it for the rest.
How many times have you heard of them "Baiting and Switching" to get you into a situation where the average person feels obligated to buy despite the "slight error" on the dealers part ?? I know of several and because of that ... I take them at their word and hold them to it or they lose the sale.
They play on the customers emotions and most of the time it works for them.

If they try to hold to the current terms, consider this, would they rather loose $800 on making the deal you want or thousands to hold to the existing terms?

You have three days to back out of any consumer contract in NC. I do not know if that applies to all states.
As far as verbal agreements they are worth the paper they are written on, you will not have a leg to stand on in court if nothing about the extra warranty wasn't in writting and you signed the contract.
If you cancel your check you MIGHT run into some serious legal problems with the dealership depending on how much they want to push it. If you wait more than a few hours on the first business day a check like that will clear a lot faster than you think, especially if it is local. You need to consider there are legal ramifications of stopping payment on a check like that. The dealership with the right attorneys and a bad attitude can come after you for the contract amount in court. If you refuse to pay they can resell the car to someone else at a lower price and make you pay the difference between your contract and what the new customer paid. It would be handled as a voluntary repossession and you will pay one way or another. Sorry to say it would be best to try to work it out with the dealership.

not trying to make light of the subject, and i know its fustrating, but, mazda is owned by ford so if it was me i never woulda bought the dern thing in the first place. but thats just me and i aint nobody

This is an intentional scam to get an xtra $795 from you, its one of the oldest tricks in the book. Kinda like the paint protection that was accidentally put on the car you ordered without it. Cancel the check or tell them to honor the warranty or it goes back.
