****! I like NM more and more, Other than up in four corners where all the natural gas wells and associated service trucks are I don't know if they have ever nailed anyone for fuel taxes, most of the time they won't stop you for no working lights much less to dip your tank.

So you just filter your wmo and pour it in the tank? Thats a great idea to reuse the waste stream.

Maybe get the sierra club to sue on your behalf......

Ok heres an update but not the one I was hoping for.

I still have not heard back from the state on my appeal but today I received a letter fro the IRS and they have also assesed me a $1000 fine based on the information and fine by the State of North Carolina.

Thats $2000 for 8 gallons of WMO or $250 a gallon.

If you base it on the current state and federal fuel tax I could have paid tax on well over 7000 gallons of fuel for that amount.

This seems to be a case of the punishment not fitting the crime.

I thought I had figured out a way to help out my wallet in a bad economy and it is going to end up costing me so much more.

Anybody want to help with a WMO fines fund. I know who the 1st recipient could be.

That sucks man. Im glad the troopers in Texas aint got that bad yet. I have know them to swab exhaust and dip tanks at stock shows but I havent heard of anybody getting fne for wmo

do you have a refueling tank in the back of your truck.
not saying i do this. but i know that many people around here use, taxed diesel in the trucks tank and off road in the refueling tank in the bed.
they have a hidden fuel line from the bed tank, to just under the firewall area. where lots of lines are located. makes it hard to follow. thats where the 2 way/4way valve is located as well. 2 way for non return systems, 4 way for fuel systems with a return line. the best way is to use two 2 way valves and wait for a few miles before returning the fuel to the taxed tank. (a timer works here well), so that you won't get red or black into the clear tank.
a switch on the dash takes care of the switching. fuel pumps may be switched this way as well.
anouther way to deal with the return line is to route it back to the supply side of the fuel filter.
then you can be dipped all they want.
and still burn what you want.
not that i would encourage, someone to do this, act of defiance.

From what I have been told if they suspect you are running it in that way they will check it right at the engine in some way.
This may be a rumor to discourage it from being done?

man, I am absolutely sickened by this turn of events! I am probably almost as upset as you are! That our gov't has the power and authority and time to waste, sticking it to you TWICE for basically using a little bit of your own ingenuity. If there is any way at all to fight this, I would pursue it just on principle.

I sent the appeal into the state with no reply so I imagine that the federal appeal will bring the same result.

I think I would be more P****d off if I wasnt still in shock over this whole thing!

You are dealing with an administrative process. You need to check up on all of the regulations regarding this process in your state, you may find that there are time limits for every step of the process and that if they fail to respond in a timely fashion then they have violated your administrative due process rights and you may be able to get a full refund. If you find that they have violated your due process rights you will probably need to take them to small claims court to force them for your refund. The judges may try to trick you in to giving them a second chance and you just say NO, The judges usually get ****** off when the state screws up. Good luck

Oh and if you win this will cause the IRS problems to go away as you are no longer guilty.

GETTING? It's been out of hand since the mid 90's, it's just getting more common to hear about it now.

More people need to take their chances and stand up to these 'officials' when things like this happen. As long as the attitude of "I'll just pay it and put it behind me" exists, things will only get worse.

There are few small township cops that target anything different lifts, smoke, tint, light covers. But that highway state patrol around here are the same way. It seems like city cops and sheriffs only pull you over for a moving violations. But never seen anyone get there tanks dipped.

Remember to this was not a DMV officer this was a North Carolina Revenue Officer with the motor fuel division.

Also I was not on the roadway my truck was parked on the side of the road on private property picking up firewood.

The law states that if you have your vehicle licensed for road use they can dip you anytime anywhere and if you refuse you still get assesed a $1000 fine for refusal to let them check.
