we finally got there..

Several years of work have gone into the creation of a new agency under the umbrella of the Adjutant Generals Office here in KS. I understand we are a pilot program for several other states. We ar eresponsible for security and law enforcement on all NG properties and wherever teh NG may deploy personell or equipment. We are intended to eventuially be a response agency for situations that require a LE presence.

As of this morning there is now the National Guard Police Dept as a commisioned and certified state LEO agency. We had our first group of officers sworn in today. I am second row to the right,looking like I am asleep....

Interesting....

A couple of questions:

Does your agency fall under state or federal jusrisdiction? i.e.: are you a branch of the NG or like a state police agency? As such, do you have statewide enforcement powers? All the time or only in a stated emergency? Can you enforce motor vehicle law? On / off installation?

Around here, I believe the state police has jurisdiction on federal installations such as an NG base. Does the KS hwy ptl do the same?

Never heard of this program but is sure sounds interesting.

I guess it was more than a couple of questions.

Steve, we are a state agency, any time the Guard is activated under federal orders they are then full time military personel and the UCMJ and apllicable regs apply. When under state orders they are state employees and the state law and NG reg apply. it can be a real headache at times.

Our jurisdiction per teh statue authorizing the agency is limited to BG property and personel, and anyplace KSNG property may be store, utilized or located...so its pretty broad in one sense, and very vague. How thats gonna pan out in real life will take time to tell.

As a full time law enforcement agnecy, we can enforce any state law or regulation governing traffic, state employees or the members of the KS National Guard.

No state agency anywhere has jurisdiction on a federal preserve, established indian reservation or property under the control and authority of the federal goverment unless a mutaul aid agreement exists authorizing that authority..


Robert, teh BOSS made me get a haircut that morning...

Mike, it hurt tho... it took a couple big guys to get it off....

Thanks for the clarification. Sounds like a big job with an interesting job description. Very broad base of powers.

We have the Job Corps in a town I used to live in. It was a federal program on a state reservation in a local town. The feds contracted with the State Police to handle law enforcement issues there. I guess thats where I got the idea that the State cops did enforcement stuff on federal lands.
