It really doesn't matter whether or not your famous. You blow in a breathilizer or walk the line still your have had one too many for the road.I actually applaud the Officer for actually doing his job. Yea the Officer is probably getting alot of flack over this but you know,He Did His Job.

To say that a .08 is barely over the line is a bit misleading. My GF recently volunteered to be a test subject for officers training to do field sobriety tests.

She could hardly walk, and spent most of the night on the bathroom floor. She didn't even make it close to .08. I don't drink much, myself, and I'm sure at a .06 I would have no buiness being on the road.

Lastly, I've seen a person or two zipped into the bag over my career, and I've seen others get sent to prison for years. Paris should be thankful that she got arrested. If you choose to drink and drive, much worse things than a brief trip to jail can happen, and no, not everyone drinks and drives.

Hopefully in the end she will learn something, and make better decisions next time.

How you react to a BAC of .08 depends a lot on your body...a 95lb woman might be flat drunk at .08, but me at 265lbs would handle it a lot better. Of course what else is in your stomach, and how often you drink can affect your behavior, too! At least that's what I see...I don't drink, but I see plenty of it

DUI and DWI are not the same. DUI is given when irratic driving is observed and a substance is thought to be present (it could be asprin). DWI has a limit and you can get one for .081 and above (i think .08 actually) under .08 and it is a DUI. In Texas we don't have DUI's anymore, just DWI.

What about all the DWS people (driving while stupid)? I'm more worried about them than anything. Or cell phone drivers? Or people eating? or READING? or looking for a CD?

If you have a cdl there is no minimum, any at all and it is a ticket and suspension.

OK here in California you have Driving under the influence (could be drugs alcohol, prescription med anything)... and yes you can be arrested for driving with a .04 BAC if it impairs you.. it is based on the Field sobriety tests. This is what you are originally arrested for.. then you go in and get your Breath test.. at that point if you are at or over .08 then you are charged with Driving while legally under the influence of alcohol. (a different section..


And to the Over zealous cop who just want publicity... Well If he let her go:

1) he (the cop) just committed a misdemeanor...

2) if she got into an accident and hurt someone he is responsible because he let her go

and as for the slap on the wrist.. Well for someone with a lot of money it is a slap on the wrist.. What is 10K to Paris... If convicted (and she probably will be).. she will pay her attorney, a fine of 1200 or so, go to a DMV hearing for her license, do community service and go to Alcohol awareness/rehab (AAA meetings)..

That is the basic for everyone with a first time DUI... Jail time does is not given out unless you are a continuous repeat offender or hurt someone while DUI.
