Generally we aren't talking about the real mental giants of the world. I think if you came upon someone stealing your property and you felt threatened the doctrine would apply IMO. Here in Austin some of these "fine citizens" have gone into live electrical substations and tried to steal the cooper wire while the line is still hot. The bodies have been found at the scene--

i've kinda wondered how the law would look at something like that, if you came upon someone burglarizing your home or auto since the Castle Doctrine has the word 'occupied' in it. say you CCW and the skell was unarmed and you took out said skell, could you be charged because the vehicle/home was unoccupied at the time, and some prosecutor said that you probably felt more ticked off than threatened?
just wondering.......

Review the recent case in Houston(I think) where a neighbor was "no billed" by the grand jury for shooting and killing a burglar who had broken into the neighbor's house.(unoccupied)

i remember hearing about this case, and a lot was made of his tone and demeanor while on the phone with the 911 operator, but he was the only one who knows if he really felt threatened or not.
my friends who are LEO's always say if you shoot a trespassing skell, take the time to drag him into the house before you call 911.

Anyone would/should feel threatened if someone was burglarizing their home and/or stealing their property. It appears that the Grand Jury believed he was threatened. Although this particular case is probably not the best case to hang your hat on. He was told repeatedly by the 911 operator not to go outside and he did anyway--after he told the operator that he was going to shoot the suspect. All 911 calls are recorded therfore a rule of thumb seems to be "Never say more words than you are willing to eat later".

At least TX has some sane ideas about property and defending it. One of the few states which allows allodial titles of land ownership.
Up here if you were getting mugged and you defended yourself youd probably be in jail. defending your home or property? good luck.
Best bet to protect your fuel tank is to get a pager alarm system and mount a perimeter sensor in such a way that the underside of the truck is covered as well.

From another perspective: what crackheads do with stolen fuel ?

Is there a "black market" like there is for stereo decks, or electronics?

I can see stealing metals and get money from a recycler, but what do they do with all that stolen fuel ?

I want to see someone hook up their lowered truck's hydraulics systemto the alarm. Leave it jacked up in th parking lot and when a motion sensor underneath the vehicle detects movement slam. Tha'll teach 'em.

Of course you'd just get sued and end up in jail for the injury you dealt the guy then while you're in here he'd take your wife. Man I should be a writer for lifetime.LOL

My Dad recently had about 10 gallons of Avgas stolen out of his airplane! Good thing he dips the tanks before he goes flying... These scumbags ought to be brougth to justice!
