My opinion is if you deserved it then fine, especially if you know your in the wrong.Some people just take it to extremes.

A local cop told me not to worry about smoke and said he didn't know of any law I'd be breaking by billowing out some clouds.

the ticket was actually a violation of city ordinance.. I didnt break any state/federal laws.. but i am screwed because of city ordinance.. it was funny tho.. The cop (woman) told me i should "maybe change my oil to fix the smoke problem". I gave her a look that had to of made her feel like the dumbest person alive.. She also tried to assign me a court date that i wouldnt be able to make because of my college course schedule, so i made her move it to a day i could make it.. lol.. i will wait and show up and see what happens, i have nothing better to do at 9am in the morning

It is only with moving violations that this can happen... excessive smoke is not a moving violation.

And in texas you can only get a ticket for it if you smoke for more than 10 consecutive seconds....So dont smoke between shifts!!!

Man you beat me to it Also your smoke cloud can not linger for more than 10 seconds. So 10sec smoke followed by 10 second linger period thats a 20 second cloud!!

You need to tell the judge you took the wise officers advise and changed your oil and it quit smoking. Something like, the molecular structure of the modified crude had depleted severly, causing it to wick around the reciprocating sealing rings of the piston into the combustion chamber causing enormous amounts of burnt crude to depart through the completely stock exhaust system leaving a colossal black cloud.

That would be incorrect... You can get non dismissible mechanical violations and loose your license..

Most Mechanical violations are dismissible if they are corrected.. Look next to the violation you will see 2 little boxes.. Dismissible and non dismissible..

Being as the Excessive smoke is a city ordinance it does not affect your driving record.. Only Vehicle code violations do..

Parking tickets, even though some are vehicle code violations are a civil matter and do not affect your driving record either (that is why they are on a different style citation)...

So just remember if you have an attitude with the cop he can and will make the violation NON Dismissible if they think you did it intentionally.. (meaning if you have a tail light out.. get it fixed it is dismissed.. if you have tinted windows you intentionally did it so non dismissible)..

Here in Los Angles the JUDGES (not to cops) have decided that tinted windows are non dismissible and a point against the driving record because it is an intentional modification...

We're talkin bout Texas junior.

they started a new law that three strikes and your out kinda deal... and it only applys to moving violations. my uncle is a JP. thats the reason I know all this crap is from talking to him and worming my way out of tickets!!!
