No muffler and there was no cat on the 99, just a resonator.
He didn't write me for noise though, he only wrote me for Illegal Exhaust.
I'm building a case so we will see.

Once again, Joel is carrying the weight of "the stacked" world.

I dunno - the grass isn't always greener; you could be living in merryland. My biggest gripes here are taxes and that gun ownership rights here are stifling - as my VA workmates like to remind me. grrrrrr

Li'l Red Express is a pretty thin argument. Factory installed, yes, but from ~27 years ago. Things change in that time. I do think the case can be won. Look at the laws preventing lifting or changing tire size that aren't set in stone. I am far from VA, but I am interested in your outcome, since Stacks are a defininte possibility in the future!

I don't think it's that thin...

the only problem I see is that the VA laws seem to read that if the vehicle doesn't have factory exhaust, that the exhaust system should be constructed so that it's similar to the factory exhaust... IE, if the OEM muffler rusts out, you can go have it replaced with a similar style muffler.

but I seriously doubt anyone gets hassled for running duals on a pickup that had single exit from the factory...

you're just getting harassed, but it's not a cut/dry case either way...

Forrest

How well did the officer look at your system? Did he get up in the bed and look down inside the stacks to see if they had a muff inside like the old side-pipes? Did he look underneath to see if there was a muff under the truck?
Here are the front and back of the original 1979 Dodge flyer.

Sorry,,,,,,,, but I gotta say this,,,,,,,, "Don't feel like the odds are STACKED against you yet"

Dieseldude,

Illinois Law is the same so here goes the flaming...

Your law says that no person shall drive and no owner of a motor vehicle shall permit or allow the operation of any vehicle on a highway unless it is equipped with an exhaust system of a type installed as standard factory equipment, or comparable to that designed for use on the particular vehicle as standard factory equipment.

That said it means your "comparable" exhaust must have the factory items including the resonator and a muffler. I don't know how you did your stacks and maybe you have a muffler(s), but if you have neither a muffler or a resonator and you get a strict to the "letter of the law" judge, the tropper shows to court, I think you will lose.

The ticket for "illegal exhaust" is a generic term on the ticket. If he can go to court and say your truck did not have a muffler on it or it was modified to make it louder, the gavel is going to fall and I am afraid not on your side.

I don't know how much tickets in VA are, but in Illinois it would be $75 paid before court. Challenge in court and win=day off work for court no lost money. Challenge in court and lose= day off work for court and fines normally start at $125, and I have seen the ticketed party make such a horrible display of themselves in court that the judge gets mad and sets a normal $75 fine at $250.

I have a 98.5, and mine had a sticker on the drivers side visor. I think it had a warning about tampering with the exhaust not sure any more the sticker is long gone.

Now the flaming starts yes, I am a cop, no I am not a trooper. Troopers seem to have more time on their hands for traffic laws like this one while I am dealing with inner city crack cocaine crimes. Yes I do show up in court because A) I am suppose to, B) I will get suspended if I don't, C) I get paid to show up.

For the record I have never written a ticket for a loud exhaust.

James

Good luck with your case, and let us know after your court day what happened.

James: Nobody is going to flame you for stating your opinion. Keep up the good work at being a cop. Like Rodney used to say "Don't get no respect".

Just like each state has it's own laws, not all police have the same function. It doesn't cost you anything extra here to fight a ticket, it's your right to do so. Court appearance is required here too. Good luck getting a warrant signed if you don't show up to hearings. Southern states tend to have "Highway Patrol". Up here they're "full service". Hillbilly's like crack and meth too.

This has already been mentioned but I was too tired last night to post it. If you have commercial plates you should be under the commercial truck laws, not the passenger car laws. Something to check into anyway.

Time off is not an issue, got over six weeks of vacation on the books and I will get paid for it.

He never looked into the bed or under the truck, he just looked at the stacks and wrote Illegal Exhaust.

I'm not sure if I'm commercial or not, probably not, but I am registered for 20,000 pounds GCVW.
