Angry Stopped for stacks

Got stopped this evening and of all places, about a mile out of Claremont. Gave me a ticket for illegal exhaust. Gotta look into it a little I guess.

I am not a big fan of stacks but I sure would like to know what they are considering illegal about them? Was it due to sound or location?

in TX, the exhaust has to exit behind, beside, or ABOVE the passenger compartment... IE, they're perfectly legal... you'll have to check your local laws.

If in doubt - take it to court....maybe you can get on People's Court ???

I have heard guys getting tickets for excessive smoke...one guy even went to court with video of the cities garbage trucks and busses....now thats excessive smoke...he walked with no fine.

I would go to court with it. The initial purpose of stacks is a safety measure. They exhaust the fumes above the cab especially at idle where monoxide can get into the cab. I have never heard of a ticket for stacks. Like was said, loud, yes, but stacks no. Tell them you ride the dogs in the bed in carriers of course and the fumes get to them. You then have a valid purpose.

I should do it to my truck just for the attention I would recieve, I've never seen a truck with stacks in this area nor has anyone else.

Unfortunately, I feel like that'd get real expensive real fast with the police on my tail. I'm a worse enough driver already...

Ya in cali. you never see them, I've seen them on some old gass crapers but thats about it, as soon as i find the money for a fun truck Im gona start the new trend, I already have the stacks just need another truck to put them on. I want too on the 97 ram but it see's 100 miles per day and my ears cant take that for that long every day, not when you've been driving a diesel tractor all day.

remember the "little red express" pickups that Dodge sold in the late 70's? they had stacks from the factory... you telling me that you'd get ticketed for driving one of those around??

study your state's laws and FIGHT IT... I'm betting they're perfectly legal...

This was a state guy just out cruising around. The bad thing is, this is just how my stupid luck works, that we see a state cop in Claremont maybe two times a year if that often. Had it been two minutes later, he would have missed me. I'm not to sure one of these knotheads in town hasn't made some calls. I don't know why, I am as quiet as I can be going out of town just for respect of others privacy. I start it up and as soon as the oil pressure comes up, I leave the driveway. Those little rice rockets use the town for a drag strip all hours of the night. It's hard to tell, he could have been looking for one of them too and just caught me in his net. He asked me how long I had them and I said about three years. He asked me if I had ever ben stopped before and I said never. Even the State Police when they were stationed at the power station entrance never said a word about them and I passed them five days a week for about a year or so.
I've got a co-worker that loves debates like this and will go and look into the law. I may just pay the fine the first time to avoid the hassle but after that, I will see what happens.
This was a real young kid and it's close the end of the month and as usual, he was probably just trying to get his quota. I've been right past the State Police barracks in Waverly hundreds of times and they never even give a look. The state inspection stations don't care as long as it's behind the cab or passenger compartment.
I pulled over here on 646 coming out of town and just as he got out of the car, the deer hunters cut loose and about eight shots went off. I told him "we are probably not setting in a real good place here" and he agreed and we left quickly. He didn't say take them off or anything, just that I had "Illegal exhaust". We'll see.

The bad thing is that you have no muffler in that system and of course you must have one to be legal. Can't you claim that your turbo is some sort of muffling device?

If you pay the fine you're admitting guilt of running an illegal exhaust. What happens the second time they show up? Merely another fine? Or will they make you remove them? Could they revoke any privileges until you comply?

I dunno; I'm no lawyer, and like Forest said, I'd probably find a pic of one of those little red wagons, and take one of yours to show to the judge and let him/her decide if the stacks are illegal.

It looks like as long as there are no leaks and it discharged to the side or rear, you are OK.
