Not Having A Good Summer.
your situation really sucks some people (not everyone)have no respect for the things there family worked so hard for and i think it's becoming more and more of a problem killing the family farm for a easy dollar
it infureates me when people break beautiful tracks of land into stupid little lots and sells them for tons of money that if a farmer buys it in no way will pencil out to be feasable to farm it
sorry about another rant its a touchy subject for me

we own 1/2 of the farm, grandma owns 1/2 of the farm, our house sets on her half, her house sets on our half, she is gonna sell my house to my cousin. i do not like this idea as you can imagine why. my grandfather was the last owner of the farm til he died and grandma got her half and the other 1/2 was tied up in court sort of til my mom recieved her half. if it comes to getting a lawyer we will.
thanks justwannabeme i will pm you for more info, the ownership is cut and dried, i got the deed, maps, and everything, we do not own the house we live in, my grandmother does, along with all the land on this side of the farm, we own the other half across the road and the house she lives in, she dosent own it. that is how it was divided. by law my grandmother can sell and do whatever she wants with the land, its in her name, lock, stock, and barrel, along with the loan, 52,000 dollars, which is what my cousin is gonna buy the house for, so she can pay the loan off.
there was no will left, so 1/2 went to my grandmother, then the other half was in suspense to see who would live the longest, my mom or grandpa's sister, well mom lived longer so she got 1/4 and her cousin carrol, grandpa's neice, got the other 1/4,(if mom died before her aunt, we didnt get anything) we co-own it with her, we can't do anything without her agreeing, we split the money and she is happy, she hasnt even seen the property, she lives in maryland. well we dont want grandma doing anything with her half cause she dosent have the attachment like we do. hope that helps some.
this stuff has been going on for about the last 2 years, grandma tried having me arrested for riding fourwheelers on MY OWN PROPERTY!!! she blamed us for all kinds of stuff and a bunch of crap that didnt happen, i watch the farm when im at home, patrol for poachers, people illegally parked, illegal hunters, all kinds of stuff, but i get blamed for people trespassing, she thinks it ME tearing stuff up.
guys and gals, this has meant alot to me, im glad other people have fell into crap like this. i havent had any support from my friends on this at all, so its just kind of me and mom against the whole "family"
i got a picture layed out of what we own, but dont know how to post it.

Normally, a house belongs to the person who owns the land it sits on. It would be very difficult or impossible to be otherwise. Do you care to post an understandable explanation of exactly how this happened, and how it is legal? I don't think ownership of a structure can be conveyed verbally when the owner dies, but the LAND must be legally transferred. Go to your county records and see who is shown on the land title, if it is still your grandfather the family might have a succession battle. Why can't you live in YOUR house on YOUR land, and how can your grandmother sell a house on land she does not own? (If these houses have wheels that's another story.)
I have a VERY simular situation and I will tell you this. GET A LAWYER ASAP !!! Disputes over a family farm are very stressful for sure.
long story short here:
My sister and I inherited 76 acres. I built my log home on it in 2001. ( sister does not live up there.) In 1998 I made the huge mistake of being nice and let her use the farm as collateral to buy a house. She never bought the house. In 2004 she got all bent out at me and my wife and she whips out this legal document that says I signed over the whole 76 acres to her !!!! And now i only have a life estate. The lawyer that wrote this up must have known what she was trying to pull because now it ends up that not only do i have a life estate I could also own the WHOLE farm if she dies before I do. !!
Also once my father dies I can boot her butt off of it for good !!
The moral to this mess is this. One---Get a lawyer !! Two-- what comes around goes around Three---People like my sister and your cousins will ALWAYS get what is comming to them in the end....

"we do not own the house we live in, my grandmother does, along with all the land on this side of the farm, we own the other half across the road and the house she lives in" as i have said 3 or 4 other times, it is her name on the deed to the land my house sets on and the deed to the house, I LIVE HERE, SHE OWNS IT, i OWN the 1/2 of the property that her house sets on, SHE LIVES THERE, WE OWN THE PROPERTY AND HOUSE. why is this so hard to understand. i got a picture of the property and how its divided if someone would like to explain to me how to post it.

If I understand this correctly then: If your grandmother is evicting you from the property (house included) that you live on, then, as hard as it may be, why can you not evict her from your property and house that she lives in? Seems to me the only thing keeping you from doing so would be that you do not legally own the land she lives on. If you do then head to your local sheriffs office and get an eviction notice. If the family wants to play hardball then sobeit. Play back. No one wants to be cruel to a family member, especially a grandparent. But if you have tried to be reasonable and they still spit on you, I would assume the gloves are off at that point. From my perspective standing outside the box, it would seem a simple moving party would be in order. Pack up your things, grandma packs up her things, trot across the street, shake hands on the yellow line and head to your respective new homes. And tell the to shut the hell up since they dont own squat!
"by law my grandmother can sell and do whatever she wants with the land, its in her name, lock, stock, and barrel, along with the loan, 52,000 dollars,"
This statement tells me that grandma owns all 650 acres though. It sounds like there is the potential for the next several generations of family to be living across the road from one another and doing alot hatin' for those generations. I hope all goes in your favor.
