Lemon Law buyback and Mods - who has done one on a CTD?
Buddy has a 05 2500, got his lawyer, almost done with the process of the Buy Back: failed pumps, bent push rods.
he's got tons of mods, Dual exhaust, Camper/Topper, nerf bars, gauges, pryo, intake.
I am in a position that he could make me a deal on some of the stuff, but he's pretty sure that DC will compensate him for the Parts.
I told him they would not.
i think we should put his truck back to as stock as possible, and put the rest of the mods on my truck. there's no reason to leave $$ on the truck when he turns it in.
can I please get a response from someone who has actually done this, not someone who's uncles cousin's did it, to give this guy some factual guidance?
what kind of inspection process is there? my understanding is just drop it off at a local dealer, and that dealer disposes of it however.
pls don't post about buying the mods on this thread, we'll do that in the classifieds, and figure out the legalities of the buyback in this thread.

I would be extremely surprised if they even cover the engine with the mods done to it. If he managed to get lucky there, there is NO WAY that they will compensate for the mods. In fact, I'm dealing with the lemon law right now with another vehicle, and the law in my state says that I'm only entitled to the original purchase price. I haven't "done" this yet, but am going through it at the moment. Lemon law buybacks usually take quite a while to go through, and are costly in the end. I've already been advised that it will likely cost me $5000+ in legal fees to fight Yamaha to get my snowmobile replaced or money refunded ($9200), and its estimated that it could be 2 years before we are done. This is after fighting with them for 3 years already over the issues it has.

Definantely with the way Dodge is I would take off every "performance" mod on the truck. If your friend has a lawyer is it because Dodge is fighting him on the lemon law? Are they fighting him because of the mods? I lemon lawed a 92 Dakota and before it got to the lemon law stage they made me a deal so that the title didn't end up marked lemon. I paid $15,000 for the Dakota and drove it 1 year 1 month and 1 day minus the 45 days it was in the shop, they gave me $13,000 for a trade and also a $4,000 rebate certificate good towards any Chrysler product, so I essentailly got $2,000 more than I paid for the truck and they kept a customer.
As far as things like the topper and nerf bars you could probably get them to pay, but I would say no to the air intake, dual exhaust and gauges and things like that.

i sued GM almost 2 years ago, 2004 GMC sierra, my lawyer said to remove anything that did not come on the truck from the factory. i ended up taking a cash settlement and trading the truck with a clean title, but it is the same as trading a truck in with mods, you won't see a dime for them. i can tell you for sure DC will not give him a dime. might as well inform him this is the way it is and then take advantage of the situation
