too soon for lemon law?

on my 4th trip back with my month old 6.7, truck has had MIL and ETC lights since about 500 miles, gets 8MPG hand calculated. currently 1152 miles. I am a patient man, but my patience is wearing thin. I realize fuel economy probably would not be considered in legal proceedings, but wondering if anyone had successfully sued on basis of undiagnosable MIL and ETC lights and repeat trips to the dealer. have had all flashes, had G30 done yesterday.

I realize it's not broken in, but breaking it in isn't going to double fuel economy, I can't afford to drive under 300 miles on a tank of fuel. 147 miles on a half a tank, while glaring in disbelief at the gauge the MIL light comes on, sad excuse for a truck. I almost want my 5.9 back even with its flaws. called my friendly dealer and told them this, doubt a phone call back is going to solve anything.

Have you had your speedo calibrated for the 35's in your sig? That will throw off mpg some. I haven't towed anything heavy yet, but I've never been below 14 since new (combined highway & city).

I'd have to drive real hard to get 8 MPG. Wonder if the truck is constantly in regen mode? I really have no idea but I hope it turns around for you. I'd be very unhappy too.

Don't know about the lemon law, but am curious on what the build date of your truck is.

Ive had mine since July 23rd and Ive been in 5 times as well. 3 CEL's, 2 Reflashes, and this doesnt include my three trips for oil changes and to have them check the oil change required warning.

I am feeling your pain... I love my truck to much to give it up though... I was at the dealership for the recall yesterday and I test drove a brand new 2007 5.9L drw... I was about to cry when I punched it on the onramp and got upto 75mph and set the cruise... I saw the MPG on the overhead reding at 15.9mpg... My truck cant get 15.9 at 60mph with a tail wind!!! I dropped the 5.9 down to 64mph and was getting about 18mpg... this is with a brand new un-broken in truck... My 6.7L has 7600 miles on it and still wont get over 12MPG on average and at best 14mpg on the freeway with a very very light foot and cruise control.

I hope that with the latest reflash and the new o2 sensor I dont have to go back to the dealership except for oil changes for a very long time....

I get 9-9.5 consistantly, I am in construction and pull a 12K excavator around everyday. When I am empty, I get close to 13, but that is rare.

That's unreal.

Just this past weekend, I averaged right at 12.5 mpg hauling this 1964 Ford Fairlane 500 from KY to Port Huron, MI. Truck has 7k miles on it and I averaged 69 mph up there. The speedometer has been recalibrated and I hand calculate all of my figures.

On the way back, unloaded, I averaged 14.9 mpg averaging about 70 mph. Not hardly as good as my ol' '03 RAM 2500, but I can't complain too much.

in big block gassers? 50/50 city/highway. city is probably closer to 6, highway closer to 10.

NICE Fairlane, I love those cars. if I can somehow get a buyback and get back into an '04 or '05 I'll be looking for a '66.

I assume the 30 day satisfaction guarantee is a thing of the past as no one I have talked to has ever heard of it. dealership manager called me back, said hope things work out and hung up before I could inquire on the status of my old truck. might have just pushed me over the edge. sad thing is I have a good local dealer that is working with me, they don't stock any diesels or I'd have bought from them.

just got off the phone with Dodge customer relations. rep was really nice for a change, I said you're probably going to be hearing from a lot of people like me. she said she does on a daily basis.

given that the truck has 1164 miles on it they'd rather handle the buyback themselves rather than get sued, ball is rolling, I am hoping to handle it through my local dealer. found an '06 Laramie identical to mine with 33K miles on it 55 miles away. if I can get into the '06 for 35K and make it like the '07 never happened that's probably what I am going to do.

trying to leave the drama out of this, but Cummins has failed Dodge and its loyal customers bigtime. I deal with Cummins professionally and this is a first. looking forward to a long weekend of swapping bumpers and leveling kits, again.

It just sucks you had to pay what you did to have this kind of experience. I know you'll keep us updated.

Just an FYI Cummins makes just the engine not the emission junk, and that is where most of the trouble is. So if you ask me it's not Cummins fault.

WHAT? Why would you pay 35K on a used vehicle with 33K miles on it? You could get a new truck for not much more. Mine was $40K before t&l.

I had a horrific experience with a 2001 Yukon XL Denali. Would have loved to lemon law that POS! Well, at least all the repairs were under warr., incl. 4 transmissions. I added up all the warr. bills and it was about $15,000.

I love my Dodge, but these trucks are American and I hate to say the Q/C levels are just not up to par. I say if you can, lemon law. If Chrysler is affraid of being sued, use that to your advantage. There are manny Lemon Law attorneys that will take the case and it won't cost you. They get paid by Chrysler after the settlement.
