Update

After many calls to different people and stops to the dealer. I went to the dealer today to get final decision from SM & DM. I was told if I gave them my Banks box and promised not to put another one on, they would order a new CP3 and reinstate my full warrany.

Well, you can't drive it without a CP3 but you can drive it without a banks. Maybe they would let you sell it, and then you could quietly buy it back.

GIVE them your Bank's Box and they'll reinstate your warranty?
Sounds like extortion to me.

You're joking, right?

Extortion is a criminal offense, which occurs when a person obtains money, behaviour, or other goods or services from another by wrongfully threatening or inflicting harm to this person, reputation, or property. Euphemistically, refraining from doing harm is sometimes called protection. Extortion is commonly practiced by organized crime groups.

The service manager said if the DM didn't want to destroy the box, he might be able to give it back later on!

Something doesnt sound right here. Why would they say we will basically give you your warranty back if you give us the box. If they cancelled it I'm pretty sure they cant get it back. Also, sounds like you are still paying for the CP3 it just will cost you whatever you paid for the box and not the price of the CP3. Just go out and buy a aftermarket setup and be done with DC. How many miles are on the truck. BTW they cant cancel the warranty on everything in the truck just what is effected by your mod.

Everyone Stop!!! Did they really say that? If so get it in writing and keep it legal. Take the deal and ask for the box back, if they won't give it too you rheem them in court for extortion. I know that this is pretty unethical but I don't see it being nearly as bad their request. That is just crap A fine company we are all doing business with

give them your box huh!!!!??????? that's about the dumbest, most childish thing I've heard in awhile!!!! & just for all you "you play, you pay" guys out there, do you not feel like you've payed enough to be able to play a little when you go out & spend $35-50,000 on a stinkin truck????? for heaven's sake, I'd imagine for what they are charging for these things these days they should warranty whatever you wanna do to it!!!! I know they're never ever going to, but you catch my drift, why is it ok for a dealer to find an uninformed guy who just goes out & buys a truck & knows nothing about it (or obviously this site) & then when it breaks give him/her the shaft on warranty work, but it's not ok for us to try & give a little back??????

short story & then I'll be quiet, my bro-in-law has a 01' 5spd 3/4 ton cummins, we use our trucks daily for hauling purposes, he & my sister hauled their horses about an hour up the road to a team roping one night about 4 months ago, after it ended I got a call saying he had no oil pressure, so I tell him to shut it off & I'll haul him another truck up & haul his back down the road to a dealership close by, well they sit in a cold truck w/no heat in the middle of winter about 1 1/2 hours waiting on me to get there, take the truck to the dealer & big surprise it was the oil pres. sending unit (like I told him the night before), then they want to charge like $250 for the part & then labor to fix it, when we asked about the warranty, they said it wasn't a warranteed part, somethin about it not being a part that made the motor run, so I told them the sensor had better be all that was wrong, because we planned on driving the thing & if it actually didn't have any oil pressure then they could just put a motor in it, I got a sending unit & went to pick the truck up & they wouldn't let me pick it up until we paid them a $60 diagnositcs fee?????? thought the P.O.S. was under warranty right????? the diagnostics fee would have been waived if the part they found bad had been under warranty, but since it wasn't we had to pay them the diagnostics fee to pick up the truck, then on top of that the woman in the service department got hateful with me when I picked it up, I told her I needed some keys & she told me she needed some $$ real hateful like , I said I thought it had been taken care of & she went into a rant about how she told him (bro-in-law) that he could not pick that truck up until the bill was paid, I said wait a minute here lady, I don't own the truck & don't really care, I get paid to pick it up, so you can take your attitude somewhere else, then I go onto the lot & the truck wasn't even locked????? talk about a sorry service dept. I went back in & gave her a mouthful about leaving a truck unlocked with personal belongings still in it, needless to say we've not been back to that dealership for anything!!!!!!, moral of this story is they don't care to take your $ any chance they get, but seem to run away from fixing anything that they can find reason not to!!!!

after that I'd like to also say that there are alot of great service dept.'s/dealerships out there, I have a really good friend who is the service manager of a dealership near by (wasn't as close for us as the moron's in the story) but they know alot about any year model cummins out there & I'd trust them to work on anything of mine, so just for the record I am generally speaking about alot of dealers across the country, but not all of them, & as far as the CP3 & warranty in ? in this thread,I'd do everything in my power to get it replaced under warranty, for crying out loud they asked to take the man's box away?????? do the "you play, you pay" guys see nothing wrong with that?????????? anyway good luck & hope it all works out in the end, Dusty

p.s. sorry for the long post

The DM or SM probably has a CTD, and is too cheap to buy his own Banks box.......so he wants to "steal" yours.

For all you "pay to play" guys........this is why THEY should pay for me to play (on a part obviously defective from the factory, going by the number of pumps going bad).......LOL!

As I as before, go to another dealer and run the vin.......see if the warranty is actually cancelled. If not, rip off the Banks stuff, and get your truck fixed already. This has gone on long enough for you.

Two can play this game! Call Banks and ask them to send you a totally dead unit which was returned to them under warranty or something. At the very least, make sure your unit is fried before handing it over to them.

I went to the dealer today to ask the service manager if they really wanting the box. I didn't tell you guys ,that I took the Banks box off (under the SM's advice) and sent it back on 3-27-06. He knew that, because I showed him the reciept from when I sent it back. He said when I get it back from Banks give it to him and they would put the order in for the CP3 & reinstate my warranty. I'm also waiting for the guys ,that gave me down the road (about me being dishonest), to read this and tell me the dealer is being honest!

First thing you need to do is call Chrysler and get them involved in this. Specifically let them in on this "extortion" that the SM and DM are trying to get in involved with. It is legally wrong and I would be willing to bet that DC would not put up with it. Now wether or not DC will cover your cp3 is another story but knowing you have this ovwer their heads they may very well do just what you want. I do agree with most on here that if you play you pay because it does state in your warranty that it will void if you install aftermarket items, but what they are doing is flat out wrong and most of us dealers will and do overlook these items for our good customers anyway.
