This is my take on the situation. Because your truck is under warranty and has future warranty they must repair it like a factory warranty repair. They should replace the longblock and turbo with new parts not remans. They should give you suitable transportation. They should fix your truck as fast as possible. They also should pay all towing costs. Thats all they owe you. Granted it is not right but it is just a unfourtunate situation for believe it or not for both parties.
Forget all the BS information others are telling you. Lawyers will cost you more money which will make it almost impossible to recoup. Yes you can trade off your truck but that has to be a deal you are comfortable with. The dealer has insurance and in my opinion a used motor is unacceptable only because the factory warranty will not cover repairs if needed to this salvage yard motor. To me this is a no brainer and the dealer should be offering you exactly what i outlined above. If you need to discuss this i would be glad to PM you my phone number.

We have dicused this over and over between my wife and myself.We want whatever was oil starved in that engine compartment to be replaced. We reall dont want a new truck as we have already installed a new exaust, gooseneck and a few other items. I had just installed my guages a few weeks ago. Like my wife was telling me our truck is awesome we really dont want a new one. We are hoping when and if we can talk to this CEO of this outfit that he will be fair .We are not trying to get something not owed to us. This has been the cause of alot of stress for us. Not to mention i usually buy feed 30 bails at a time and that time is comming next week. What am i suppose to do. We probly cant carry more than 10 bales at a time in this half ton as it has no gooseneck. Its cheaper for me to buy it myself than having it deliered.
I was wondering if we do get the engine replaced. we travel to New Mexico alot to see my family if i had problems with the new engine out of state or anywhere we go am i going to have trouble having warrant work with an other dealer cause of engine replacement .If any one has any more input but dont want to post it just email jrosco7@msn.com. That is why i said you need and want repairs done in such a way that if you do have problems and dealer will honor the warranty. I have made these repairs for mis-fourtunate people like you before. I have 30 years of dealership experience. You should get a long block and turbo.

then I would tell the dealership this and demand a long block! I agree about the squeeky wheel. But I have seen it backfire also. My good one was a set of tires on our liberty. They were on the "owed to customer" sheet but denied after the weekend when I came back to get them. When I tried to return the vehicle later that week because they were unable to get me what I wanted. I was told I couldn't return it because I had owned it for more than their 3 day grace period. I dropped the keys on the desk and asked for a ride to my lawyers office. The eyes got big and the numbers started rolling!! I ended up keeping my tires (which I sold for $300.) and getting a check for another $500.00 on the spot to buy whatever kind of tires I wanted.... Thanks!
Now the bad one is my ford which most of you know about short and sweet: Head gaskets on a 6.0! Not covered under warranty. Still fighting with dealer and ford. a year and a half later.

I agree!!!! LONG BLOCK!!!!

Time for a name!!

Horsepoor -
If you're out posting fliers (etc.) think it's time to put
the dealership name, and the owner's name - or
highest ranking dude's name you know -and address- on HERE!

Time for a little "reverse PR". All these posters need to
send them a POLITE note - saying that they [or their, cousin,
brother, or?] lives near there and will certainly spread the word
among their friends, neighbors, and relatives -
NOT to buy a car or truck there.

In that note they will also -
name all the DODGE forums they belong to - and will spread the
"negative" word - by way of your story.

Anybody reading this - would YOU buy from this dealer?
I think not.

If that is not allowed on the forum (Moderator?) - send each of us
who have posted here a PM with that info. Refer to this post.

Also - I bought my '05 at about 2% under invoice [without going to
Idaho or St. Louis [which would have been 3% under],
with rebates AFTER that.
I didn't have any "kinfolk" working for Dodge, etc.

My point is - the dealer that's selling you a truck at "invoice"
is -STILL- taking advantage of a bad (your) situation!

Maybe put a sign up in the back of your loaner truck that they gave you that gives a short explanation of how the dealer is treating you. Whatever you do, don't back down. Good Luck

Please post the dealers name and email contact so I can email them. I am very interested in a couple fleet trucks and after I talk with them for a few and after they work up their numbers, I will drop the "heard this story" and tell them to SERVICE PAYS and to get lost!!! That will get them. If this happens a few times they will think the bad word is spreading!!!

Don't give in.........you will probably win in court.........this is only my opinion before I offend alot of people...........It is my opinion, and experience from a lemon law case where I represented myself, and WON, that the judges' in our court system are well aware that 99.9999% of all car dealers are crooked as a dogs hind leg and if the consumer seems to be in the right the decision is usually in favor of the consumer. I know of at least 7 lawsuits involving dodge dealerships right here in central and east texas and the consumers won every one of them, and some of them was for big $$...............

I feel your pain as I have been down that road...........good luck and God Bless............hope you get your truck fixed...................

Try this FIRST and save legal fees....I learned it through expirence with arbritration and insurance carriers...

Your lawyer will ask and demand a "like kind and quality" engine when repaired, (if they install a new unit you will be responsible for the cost in reduced miles, of the new engine over the life expectancy of your current 20,000 mile engine, typically 10-15% for betterment.) Your lawyer will demand the diminished value of your truck be reimbursed you in the form of a cash payment. These at minumin.

1) Tell the dealer you prefer to have Cummins repair the engine damage because you have "lost confience" in their repair abilies
and
2) have 3 different dealers make offer to buy the truck knowing the engine was replaced.

The average of these 3 offers will give you the reduced value. Subtract the reduced value from the value of your truck remember to add all the options. That is the $$$$ amount of money owed you for the "botched repair".

Once they determine the reduced value number is larger than the "betterment", the ball begins to roll down on them fast, they can not use "internal cost" reductions to pull them out and they will begin to go into the "cut our losses" mode.

Their insurance carrier will use the exact same formulas to determine the numbers and claim amount. The dealer will try anything to keep from submitting a claim and do the repair internally to save costs. Demand they notify and file a claim with their insurance carrier.

Tell them Cummins will handle the claim for the engine repair for you. Just supply the loaner while work is done. (Cummins will install a 6 speed in thier rear for you because they have never agreed with DC or Chrys Corp on the little things they attempted to do over the 12-3 years on these engines.) The dealer will absolutely hate this and it will set them on fire. They will have to pay Cummins labor rates and that burns their hide to a crispy brown.

When you let them know this, they may make a move to get you out of their pubic hair.

Encourage your wife to act like a real crab, the more the itch the more they want to get it over with.

How did I gain this information? 94 buy back brakes, 95 buy back brakes , 97 replaced auto trans 3X's and buy back, 2000 buyback, no paint on entire bottom of truck or bed.just primed........still driving the 1.5
