Was the level high the last time you checked it? If it is higher now then when you checked it last, you have a problem.
If the oil was changed recently, and too much oil was put in, then the tube will most likely spit oil until the level drops to about the "full" mark. That is normal in my truck. Sometimes when I change the oil, I do not get all the old oil out. When I add 3 gallons of new oil, it is overfilled a little. Spits oil until the level drops to an acceptable level.

False alarm! It was my dads truck, he had a oil bottle in the bed of his truck an the cap wasnt tight. He has a cove so we couldnt see it. Thanks for all the help!
