I think in Texas three repairs for the same problem and no resolution to the problem, you have a lemon.
I would check the law in Arizona about how it works there.

I fully understand your trouble with the dealer. I have been fighting an uphill battle with mine over a recent hack job to my interior by a contracted glass tech. > For starters, they should have put you in a loner until you have gotten your truck back in the shape that it is suppose to be in (BRAND NEW). Second Lemon laws are pretty standerd 3 strikes and your out. I would seriously consider a new truck. Once your on that downhill slide, sometimes there is no getting back up. Does your truck have lmt slip rear? When it came time for me to service my diffs. I had a question about addative for the lmt slip rear and the guy said that I had to add it. Obvioulsy this contradicted what the mannual says so I posted it up here and found that no addative was required, and damages could result if it were to be used. I would check that the dealer didn't mistakenly put addative in the rear diff. thinking it was a dana rear end. It is quite clear to me that several dealerships don't have as qualified personel as they lead you to believe. That is why my confidence in dealership service and quality of work has little to be desired.

I hated to post this but when I got the truck back with the "New Rear End" still whines. and Dodge knows of the problems but has no fix to date

My Notes when I spoke to: AA&M (American Axle) the people that made the Rear End. admits there is a problem with the Dodge 3500 2X4 140.5 wheelbase with he 5.9 Cummins seems that there is a whine coming from the rear end and they are trying to work a fix for the problem. He seems to think that that the drive shaft has a 85 Hertz Dampener on it now creating a harmonic noise through the truck. His suggestion was to try the "new" 385 Hertz dampener it's not known if this will work for sure either but it is worth a try he thinks?

I also believe that is why Dodge is not offering the 3.73 Ratio's in the 2004 until they have the problem solved for sure ........ huummmm who designes this stuff??
???

I would like to know if "anyone" out there has a Non whining 3.73 Ratio in a 4X2 140.5 wheelbase 5.9 ?? BTW it starts at about 60mph

I took one look at it and I was HOT there were no svc departments open as its sunday here, But tomorrow Im going on a ramping bi@#hing party with them. I told one dealer already that there was a noise from the rear but they said." we drove it and can find no noise or any abnormality. your probly hearing the resonance from the exhaust" can you belive that load!! Ill post tomorrow what i find Im getting a new rear or there buying this thing back not paying 40,000 for crap like this.at only 15,000 miles.
