Dealership refuses to honor warranty. Need advise.

Exclamation Dealership refuses to honor warranty. Need advise.

First I want to state that these forums are great and I have followed the advise of several people on here. Thanks to everyone who makes this source of information possible.

I have a 2002 Dodge Ram 2500 with 121,000 miles. I have had a "dead pedal" problem and am getting the 0216 code. I have already tried to reset the APPS (according to advise on this forum) and it did not work. When I took it to the dealership, they said that it is no longer covered under warranty. That is a bunch of bull because of section 2.6 in the warranty book that states the 5/100 warranty does NOT BEGIN until AFTER the 3/36 ends. You can even go on the Dodge web site and look up the warranty info and it says the same exact thing. Regardless, they won't fix it. I spoke to the manager of the dealership and he also refuses. I have called Chrysler's customer reps, and they won't acknowledge what their own book says either. I filed a complaint with them and I am sure that will amount to nothing. So my question is... What now? Has anyone had any luck with getting them to honor their warranty? If so, how? I guess my next step should be filing a claim with the Better Business Bureau. A lawyer may be helpful, but would probably cost as much as paying to fix the problem. I may see if I can get the dealership to write something saying they will not fix it. That should help in the future if I pursue this. What is the use of having warranties if they don't mean anything and nobody will stand behind them? It is plainly stated in black and white in their own book. How can they continue to get away with this?! UGH!

I have always understood the phrase "begins after the 3/36 ends" as the point where aditional Cummins related items are covered and maybe where Cummins takes over the cost/responsibility from Dodge and extends it to 5 yrs/100,000 miles. Not a point where the odometer and calender start over again.

I'm no lawyer and have never had to test it so I can't say for sure!
That's just the way it was explained to me by a friend who runs a Dodge dealership.
I do know the coverage is often referred to on this site as ending after 5 yrs and 100,000 miles.

As you probably already know.... the P0216 code is a strong indicator that you need a new VP-44 fuel pump.

I am not positive about whose responsibility it would be, but this is in the Dodge warranty information book and is also on their warranty information on their web site. That would mean to me that it is the dealerships and/or Dodge's obligation to fix this problem.


So here is what I now have so far :

They charged me $42.93 to look at it, and the invoice states "Diagnosed and found injection pump timing failure, could be caused by restriction in fuel system. Recommend replacing fuel filter and if problem persisted the injection pump will need to be replaced."

I spoke again to the service manager and asked if they could write something out about the warranty and the fact that they would not fix it. He agreed. I was surprised. After he returned with it, I asked if the GM would sign it as well and he did. The GM came out to talk to me and was actually very polite about it. He stated that he wished he could help me, but that he couldn't do anything based on the VIP summary report.

The thing that they wrote out, signed, and gave to me contradicts itelf. It says "The Cummins Diesel engine warranty starts when the basic warranty begins. The diesel warranty is not used until the basic warranty ends, since the diesel warranty has a customer pay deductible, and the basic warranty doesn't, the diesel warranty is not used until the basic warranty expires. The diesel warranty ends at 5yrs or 100,000 miles from the in service date which was May 8th 2002." The first sentence says BEGINS but then they talk about after it ENDS. Now how does that make any sense?

They refer to section 2.5 of the warranty manual when they talk to me, which speaks about the federal emission warranty. But, section 2.6 is the section about the Cummins diesel engine limited warranty that says "If your truck is equipped with a Cummins Diesel Engine, the Cummins Diesel Engine Limited Warranty begins at the end of the 3/36 Basic Limited Warranty period, and covers the cost of repairing those parts of your truck engine listed that are defective in materials, workmanship, or factory preparation. In trucks equipped with a Cummins Diesel Engine, ONLY the following engine parts and components are covered for 5 years or 100,000 miles, whichever occurs first:..." The way I understand this, the actual warranty, according to the way this is worded, is the 3/36 basic warranty plus the 5/100 warranty. This means that it should be covered for 8/136. Am I not understanding this warranty book?

I called the Cummins customer service just for the heck of it. He agreed with me and said that the way it is worded it sounds like the warranty should be honored. He said that Cummins has its own warranty but that Dodge is solely responsible for their own warranty. Next I am calling the BBB. I am going to dig into this as much as possible and will post updates as they come. Would appreciate any other suggestions or advise!

I've ready many times on this site about people having to fight for the warranty just like you're doing with the end results of DC fixing. Good luck.

I fought the same issue and won. $200 deductible and a new VP via Chrysler. I had the regional manager involved and a good sales man and shop supervisor. 1 day on the phone with these 3 individuals and I was in the shop getting it repaired the next day. Chrysler's 800# is worthless and your talking to someone overseas.

Keep on them and threaten, in a nice way, you will get the states Attorney General involved if necessary.

Be polite but stay strong.

Building frustration here. Just got off the phone with the BBB and then the district attorney office. I was advised from the person on the phone at the BBB to call the district attorney. So the woman at the DA tells me that because I do not live here, I am here with work, that they can't do anything with it. I would have to go through my state attorrney's office. That does me no good. I can't take that kind of time off work and just go roaming around waiting for people to do something about this issue. I also called another dealership and they said the same thing. No go. How do I get a hold of the Regional manager?

Do you personally know anyone at a dealership? I went through our sales men and he contacted the regional manager.

Search under user name Tomas, he has a very well documented case with photos and everything you should need to get the ball rolling.

Thats exactly right. The cummins warranty takes over the warranty does not start over.

Everyone knows the trucks warranty ended at 100,000 miles. The warranty was explained when you bought it.

Cummins has absolutely no responsibility to the Dodge truck owners. The engine is covered by Dodge as they buy the engines from Cummins. The warranty is up to the Dodge co. I got mine replaced by the dealer and then faxed all of my info to Dodge with the pages right out of their own warranty book. I got a check back from the minus the 100 dollar deductible. It can be done just have to be persistent. The dealer WILL fight you on this. The kicker is you have to have the work done FIRST.

Follow Thomas's advice. Be persistent. This will get resolved very promptly when you finally make your way to the Chrysler Early Resolution Program / Attorneys....the warranty / service department drags it on to the point of no end. It may help to hire an attorney, sadly.

Yes and No, that's what they said when we bought it but not what it says in their manual. Read every other motor warranty in the manual and the wording is different only for the Cummins engine. I searched and searched when my VP died for this loop hole. The first dealer I tried always said "the computer says" your out of warranty. I was finally able to get the 2nd dealer, yes I've bought 2 trucks from them, to listen to my story, and I will buy my next truck from them for taking care of me.

But they (the dealership) did not front the cost, they received "help" from Chrysler. The wording in the manual is well known by Chrysler and warrantied by Chrysler back to the dealer. I believe the wording in the manual changed in 06 or 07 just for this reason.

Keep up the good fight. Per the manual your covered for engine/parts only for 8/136.

I know when I purchased my 2002, 2500 I got a 7 year 100k warranty.

I've been through 1 vp44 at 67k, I'm now at 83k. I paid out of pocket and then was reimbursed.
