warrant for arrest

I think I have a warrant out for me, anyone got a spare room!!

no honestly I think I do have a warrant out for me. I got into a fight in Az and didnt throw a punch. Some fight, well the wife and I got a summons for court, thing is it was in AZ and we live in Or. There was no way we could have made it down there, since we are packing the house getting ready to move again. We misplaced the court papers I'm looking online for a number to call to startighten it out and make sure I dont get arrested. The guy that hit me i believe got charged with a felony, actually I got jumped by 4 guys. just a black eye, and broken glasses. Wasn't even my fault Seriously though, anyone know how to deal with this?? I'm not definate that there is one, just we got a paper saying they would put one out if we didnt show. It would suck to get pulled over towing our stuff back to FL, they find the warant, regardless of the reason, then get thrown in jail, truck, trailer, household goods impounded/stolen, and the kid sent to a foster home, and the pets put down. Don't want my case to turn into another guilty till proven innocent.

Hire a good local lawyer and they should be able to wade through all the necessary paperwork.

Having been through the court system .......GET A GOOD LAWYER!

Was the summons to appear in court to testify against the others, or were you actually charged with assault or something similar?

If it is just a misdemeanor warrant you won't have to worry about being arrested unless you come back to Arizona - most likely they won't even extradite unless you're in the county where the warrant was issued. Heck, even most "minor" felony crimes don't rate extradition from out of state - I know where a couple absconders from my caseload are but the court doesn't want to pay to bring them back to Arizona.

Regardless, you still need to take care of it. Where did the incident happen? I'd contact the court and let them know that you live out of state, and would like to resolve the issue somehow, preferably without returning to Arizona. If you were charged with a crime you'll probably want to contact a lawyer in the jurisdiction the incident occurred in. An attorney would likely be able to work out most details so that any trips to Arizona would be at a minimum, if at all (depending on the severity of the charge).

If you let me know where the incident occurred, or which court this involves, I can try to find a number for you to call to get things started.

It happened Chandler, AZ. I've been so absent minded recently, have lots going on with the move coming up. If I remember, it was to appear in court to testify against him. The whole incident was caught on camera, and I never threw a punch, I stayed and talked to the cops that night and said I would have been arrested then and there if the tape showed anything else, (me fighting back)the other guys ran. I know that really wont matter in court, but I believe it was to testify against. I missed the day, forgot to call them, and been packing the house up ever since and still can't find the papers. Probably a bench warrant. Call the clerk of the court down there to see what the nature of the warrant is. I would hold off on the Lawyer, they are used best by gulity people.

i would do a search on that counties public record. long story short i was arested for a 31$ fine that i never appeared in court for because i never received a court date. they took me to jail because of the bench warrent i post my 100 bail and went home, jumped on the net and paid the 31 fine and am cleared of all charges, even got my bail money back 30 days later. any questions, drop me a note homeloanjoe@aol.com

Call the court and find out exactly what the warrant is for. They probably can't tell you over the phone, but at least you can give them a valid address to send the info to you. They're not gonna come get you in Oregon, so don't be scared to give them your info. The sooner and quicker you act, the more serious they'll take you. You could never go to Arizona again and not have problems, but it could affect employment, credit, heck who knows what insurance companies can access these days? Could be anything from failing to appear in court, disorderly, or maybe you got in one more good one than you thought and one of the guys are charging you. If you fail to show for an interview to tell your side, a bruise is enuff to get a warrant, but remember a warrant is just getting you to court, doesn't say whether you're guilty.

Also, when you find out what it is for, consider your own lawyer, preferably somebody familiar with that particular court.

Well, I don't usually associate with outlaws like yourself but in order to keep my city from getting a bad reputation, here is the court information.

Chandler City Courts

So... where did this happen? Come on, we want the dirt!

I know from some um... personal experience... that typically the police will just file assault charges against all parties involved and let the Judge figure it out. If you weren't arrested or cited at the time of the incident, your summons was probably just to testify against the punks. If that was the case, you should have called the prosecutor and given a phone deposition.

Sorry guys,

I learned the hard way!

17 months of 2x per month court dates, polygraph, my house, car, credit, and +/-$23k cash.

(All charges were dropped when the 2nd X could not pass the polygraph!)

A good lawyer from the jurisdiction where the problem occurred is invaluable!!

NO ONE in the court system has your best interest in mind!

If the guy was charged with a felony, the case will be handled in Maricopa County Superior Court. Even if the police charged him with a felony initially, there is a chance that the county attorney declined to prosecute as a felony (fairly common if there were no weapons or serious injuries), so it is possible that it ended up in Chandler City Court.

Contact the courts and they will be able to tell you if a warrant issued, and they can help you start the process of getting it cleared up. Good luck.

The place of interest was the Denny's by I-10, I think on Chandler Blvd? or Ray. I know where it is just not actual street names!!
Quick run down, a loud really annoying guy was runnig his mouth, annoying the waitresses and other customers, My wife stood up as him to be quite, he got out and ran around about 3 tables heading towards where she was standing. I got in his way, and asked WTH? without stopping, he hit me in the eye while running, I took one step back and said WTH again, that time his friend jumped me from behind, pushed my head through a glass divder between booths, my foot knocked over a gumball machine and a tank full of water and change, I just sat there with a total of 4 guys on me hitting kicking, (thats what my friends told me happened), I start standing up lifting all 4 guys up with me! My buddies start grabbing the other guys off me, one even turns and hits my wife! Well she punched him and busted his nose, the guy that hit me, jumped back on me got me in a head lock, the wife comes up and grabs his "equipment" I throw him off, he gets up and runs out the door.
I never got to return the favor of getting hit in the eye! Thats probably better, since the cop said that I did not instigate anything, I didnt run up with my fists up or anything. I had no intention of fighting. Oh well. This happened about 3am. Go figure. Good thing is the people were glad we chased them out and they gave us all their food they ordered! Oh had a Dodge Ram that he left in theparking lot, it was a gasser, the cops disconnected the battery and some wires so he couldn't come get the truck. I was hoping for some parts.


I got some numbers so I get to play phone tag tomorrow. Thanks, I'll keep you all posted, errr maybe some of all you can post bail for me????

Thumbs up UPDATE!!

Well I played phone tag, and called the courts that handle felonys. They had nothing. Called the city court they searched, pulled up my previous traffic tickets I had [whislte] so they had the right file, and could see no warrant/bench warrant. So hopefully I dont have one and wont have an unexpected one night stay in local "hotel" Well only one night unless the wife is mad at me that day!!

Thanks again for all the help. So hopefully I be free!! [pokes head up from behind shrubs]
