neighbors !!!!!

I need some of you armchair lawyers to give out a little advice.
I have a neighbor that is to say the least is a little weird. He has piled dirt up all the way around his property at lest 6 ‘ high. He has tried to beat another neighbor up. He has put no trespassing signs up every 10’ –15’.
His place is only about 3 acres. And he has cut most of the trees down (this place was covered with post oaks) he has used brush in the places that he was unable to pile dirt and then put up a 8’ corrugated sheet iron fence. Just recently he pulled a pistol on someone that only needed to ask a question.
The above is just some of the things that he has done over the last few years. He has only tried to get away with a few things with me (think it has something to do with the fact that I stand 6’3’ and wt 260#.). Also could be that I told him once that I would remove a part of his body and clean by barn out if he even looked like he was going to get stupid with me. My wife feels the need to go armed even in the front yard.

To make this long story a little bit shorter he seems to be getting worse. Other neighbors are having more trouble than I am but I feel that it is coming. I know what I would like to do but then I would be on the inside looking out. So that is not an option. Does anyone have some advice that may help. Not a lot of money so the courts most likely will not do anything (at least not until he goes over the edge and hurts someone). I do understand that all advice is only your opinion so no one will be held liable but I am looking for other angles on this problem. Thanks

I can't be much help as I'm not a lawyer or police officer, but in Michigan your neighbor would be headed for jail just for pulling a gun on someone, I'm pretty sure. I take it that there are no property restrictions in your neck of the woods. I would document all of his bizarre behavior and talk to your county prosecutor. FWIW.

Ok, all disclaimers apply...

Guns and freaks like him are bad news. Better to call someone to get him removed fast. He is probably a nut case and can be certified. Let the Sheriff deal with him. Just because he can carry a gun around does not mean he can point one at poeple without a reason.

I got popped in the left leg when I was younger from a freak like him. 30 cal rifle. Could have been my guts or head. Get him outta there before someone gets hurt or killed.

Dont play Cowboy...unless you REALLY know what your doing. Johnson County has a good Sheriff. Call them tonight, not tomorrow.

get your neighbors together and call the sheriff, the more the better. It lets the sheriff know it's not just you having the problem.

Thanks guys, that sounds like good advice.
In the past I have spoken with the sheriff department and I got the old
“ There is nothing that we can do” At least until he hurts someone. The person that he pulled the gun on did not want to press charges (was afraid that his family would be the ones that suffered) so that’s not going to work. I like the idea about documenting his activities. That way others or I would at least have a leg to stand on if something where to happen.

Another option would be contacting the social services department in you you county. You can voice your concern about "the mental health" of this individual. Let's face it, this is not the action of a "normal" person. Heck they may even have information on him already.

This guy could ave a history of mental health problems already. Many people with a mental illness history are not allowed to posses a firearm per law. Maybe this guy "is off his medication again".

I don't mean to scare you, but if this is the case, then you have a time bomb on your hands. That's a part of the reason that social services departments exist. It may be called something different in your state, but it's something I would look into. This is not normal behavior.

When dealing with officials about this problem, make sure you write down names, and make sure they know you are documenting who you talk to. People react a little different when they know that they will be held accountable. Do you want to be on record as the person who blew this problem off only to find out later that the this nut killed somebody? It's a shame to have to do this, but it does get results.

The other option I won't discuss, but it can solve the problem quickly. Good luck, Kevin

sounds like a recent "King of the Hill" episode. A popular pro football player moves into the neighborhood. The new neighbor and his friends wreck havoc on the neighborhood, the cops don't even help. Funny show. If you live in a town with lots of ordnances, sounds like his junk yard would be a eyesore.

It's all great advise. I say the same, document everything on paper and with camera, (dates and times). Don't let him bully you guy's around but use your local law enforcment instead of your hands or gun's. We all want to kick the butt of people like this but unfortunately we are the ones to get introuble for trying to do the right thing in our minds.

Say a prayer for him first, Then do what some of the others have stated,I being a retired firefighter has seen some bad things between neighbors,and I know for a fact that you need to keep the communication between the neighbors,yourself and the local law enforcement going,everything the man does get it documented,and I do not mean just call in,have them fill out a report,make them aware of his every move,someone that wants to isolate himself like you described should throw up warning flags to the local law,video,get all the neigbors together and get him some help.Goodluck Rick

I agree Document EVERYTHING! make sure you get an Officers signature on on every call about this guy.

I had a neighbor like this many years ago, he just kept getting closer and closer to the edge, One night he came to my home banging on the door about some nonsense I can't even recall now. He vented, huffed and puffed and told me he would blow my house up with myself and wife and children in it. He then left.

Later that night he came back, and beat on the door again, I had placed my Rem 870 12 ga behind the door and opened it. The guy was livid and completely incoherent he was blabbering about killing all of us and all the times I called the police on this guy came to mind.

I motioned to my wife to grab the children and head for the back of the house as I tried to calm this freak down, but he just kept getting madder and madder, finally he reached in his pocket and pulled out a pistol.

I grabbed the shotgun from behind the door, racked a round in the chamber and shot him dead with a single shot to the chest.

The police came and investigated me and him : and found he had dynamite and hand grenades under his bed, the guy was also wanted on several out of state warrants. He meant it when he said he would blow up my home.!

Don't let this happen to you, document everything and be a thorn to the DA and Police to be sure they check this loony out thoroughly.

He may need some help and with the proper medication be the best neighbor you ever had, lets hope he gets the help he obviously needs.

Good luck and don't take the matter in your own hands unless it is the last option as it was for me, I knew when I saw the pistol he intended to kill me and my family, and reacted accordingly.

I would have preferred it had ended much differently.

Yikes.........Lary, consider yourself lucky that you live in a country that allows you to protect yourself and your family. Believe it or not, if you did that where I live....you'd still be in jail. And no Im not kidding.

Thats has to be a terrible situation to be put into. I don't own any guns (I have nothing at all against them) but stories like that have me considering purchasing one for my families protection. Wish you and your family a happy thanksgiving.

Great advise all...another thing you could do is get yourself down to City hall, your Municipality and/or County by-laws dept. Quite often there will be height restrictions for fences on the books, there may also be an "unsightly/unkempt" property law. Your by-law office should be chockfulla restrictions this guy has broken...all you have to do is get the County bylaws guy to check him out. When the fireworks begin... pull out your lawn chair and enjoy the show!
