Well my brother got himself in a pickkle this time. Were gonna make a longer story short. Anyway My brother had 3 roommates. WHich was all good. Were the problem comes in is there were some down falls. Actually one roommate got mad because we brought some friends over. Biggest reason we didnt care, he always did it himself when we were trying to sleep. THis was a darn friday, he just wanted the place alone to his gf and so he called the cops out on the part. And yes there was some "Controled" underage drinkkin. no one was drunk. just all got back from the bar and what not. So thats why the cops deal is a problem............. Back to the main point
The roommate decided to move out. Which is fine to each their own. But they have a 1 year lease. And he decided not to pay. Luckky enough my brother did. So in that case hes in the clear persay. (shows his good faith when this all goes to court) The roommate also wont pay hyim back for his 3rd of the utilities. So i helped the good ole college student with that
The other roommate ( i said there was 3) Moved out back in december. But she kept payin her rent, So she was all good untilthe other one moved out ( there cousins) So both stopped paying.
Since she moved out. I had a little agreement with the other two that if i pick up her 3rd of the utilites. id stay there on weekends, and weds night so i could deposit my payckeck on thursday ( he lives 3 miles from my work. I likve 32 so economical sence)
What that turned out to get was somehow his landlord thinks that its a common law. Now im responcible Which i guess i dont see being I didnt sign an agreemen with him, and 2 days a week is just like if your gf/bf came over in which case she wouldnt be responsible either.
Then he evicted the brother but still expects them to pay rent?
So my question to those more in the know than I am,
1 is there really a common law? I live in iowa and cant find it anywhere in the code books
2 by evicting doesnt that terminate the lease agreement so no more rent is rendured due except for payment on damages ( carpet stains)
Biggest reason i question it, This land lord is purty crookked, Likes to steal cable and what the not. So just wondering whats going on

not sure about Iowa, in Oklahoma, common law marrage is recognized for most things. Sounds like its time to talk to a lawyer. Other than taking you to small claims court, there isn't alot he can do. However, the people with their name on the lease should be the only ones that can be held responsible.

hahaha oz you stole my thunder. I was gonna say that it sounded like a bad jerry springer episode. My thinking on this is that you didn't have any kind of contract with the owner written or otherwise. He has no basis to bring a claim against you, and you have no liability to pay on someone elses contractual agreement.
