The article only said murder charge (not charges, plural), implying that there was perhaps only one murder charge. They were both charged with the animal assault, though.....which I don't understand....I would think only the driver would have been charged for that.....sounds like there is more to this story than what is being reported (what else is new?!).

Rob, per the info on PoliceOne, both had just been involved in a theft( of gas of all things) and this is why they were fleeing from officers. Since the passenger was activily involved in the initial crime(theft) that makes him co-liable for the death that subsequently resulted from it.

Cause of Death: Vehicular Assault
Incident Details: Deputy Sean Pursifull was killed when his parked patrol car was intentionally rammed by a suspect fleeing a trooper from the Kentucky State Police. The two juvenile suspects in the car had just stolen gas from a service station in Baster and then fled down US 119.
As the vehicle fled from the state troopers, the driver crossed the center line and rammed Deputy Pursifull's patrol car, which was parked at the time. Deputy Pursifull and his K9 partner, King, were both killed.
The two suspects were taken into custody and charged with murder and assault on a service animal.
