Dealership Warranty Scam!?!? (long)
Dealership Warranty Scam!?!? (long)
Ok, so I bought my 2001 New in Oct of 2001 for 30,500.00. The original MSRP was 38k with an added markup that brought it to around 43k. It turned into a major fiasco with the dealership and they were all upset cause apparently they lost 1900.00 on the truck, that was after the money they also made on the extended warranty. It was just after 9-11 and nobody was buying anything, I assume that's why I got the deal that I got. Anyways, it was a big ugly situation where they tried to get the truck back from me after a 10 day "right to recind" that had expired and I told them to pound sand cause I had already lifted it, wheels, tires, stereo (which I waited to do till after the 10 days). Anyways, they had a problem with the financing cause I had too many vehicles financed at the time so I ended up trading one in (which they had to give me pay-off for that ended up being a lot closer to retail book than trade in book but their hands were tied)
Ok, so they charged me 2420.00 for a 100k, 7year warranty through AN GOLD? Well I have 60k on the truck now and I know that they won't cover many issues now due to mods so I figured I should cut my losses and request a prorated refund.
I go to the dealership to do it and they need my VIN to get the warranty info. They check it and then tell me that there is no warranty on this truck! I say that there is and I was charged for it. They ask for a copy of my original sales contract and I say I don't have it. I didn't tell them that I was looking for a refund, I was just inquiring who the warranty was through cause I knew it wasn't DC. They say that they have to retrieve a copy from storage and they will give me a call tomorrow when they get it. That was two weeks ago and I have recieved no call.
I was talking to buddy that used to be in the "car business" and he says that because of the loss they took on the truck, they probably never purchased the warranty in hopes that I would never need it but charged me for it to offset their loss. He said I should be entitled to the entire amount since the warranty was never even purchased.
I figure that if I make a stink with no proof then they will just say "oh, here it is" and either purchase it then or ask what my issue is so that if I say I want a refund then they prorate what it would be. Basically, they charge me $2420 for nothing and refund back $900 or whatever for their little scam.
I don't know what I should do here now so any advice would be great!
Sorry for how long this is but I wanted to make it clear.

If you "asked" the dealer if you had a contract the only one they can search for by vin on the DC network is one that is a Chrysler Service Contract. If it is an aftermarket one YOU need to have that info to present to the service department. "They charge 2400 for nothing"...well if you haven't had to use it...yes. Now if you were getting a trans replaced or some major A/C work done and only had to pay a small deductable I'm sure your story would change. I work on the things so I don't charge myself labor, and I get my parts cheaper, and I still contract my vehicles for the longest term I can. I had to use it once on my last truck and it definately helped having it.
I purchased the extended warranty when I bought my truck, then found out a year later they did not purchase the warranty. I got every penny back, but I had a copy of the contract.
This is why you want to keep a copy of ALL your contracts and receipts. Just toss them in a box, and hang onto them, as you can see, you never know when you will need it
Good luck!

What should I do now?
Fantastic! Now you are loaded for bear
I would go to the Dealer with a copy of the receipt you have, (don't hand away the real one) and find out why they are showing you as not having purchased the warranty?
Then after confirming you do not have it, demand your money back. Obviously they do not have a leg to stand on, so they have to either return your money, or show proof that you do indeed have the extended warranty.
Keep in mind that if you financed the truck, they will most likely send the money to the lien holder, and you will get that amount removed from your debt. Also you can get the interest back you paid on the insurance as well, since you did not receive the benefit of what you paid for.
I was able to get a check for the total amount, but I paid cash for my truck new
If they don't want to work with you, you can call DC and also your local District Attorney, as that is fraud.
My Dealer feigned the excuse that they forgot to send in the payment, but were happy to pay it back so I would not be pressing charges.
