Well it's been almost 2yrs since my motorcycle accident & I'm finally going to get my day in court.
June 26 2002 I was riding my Harley on a country road out by Mark Smiths & I came around a corner & there was a cable accross the road, neck level. My first thought was a power line & I'm going to get electricuted. I jumped on the brakes front & rear but could see I wasn't going to be able to stop in time so I let up on the front brake & layed her down. I slid right under the line. Six broken ribs a punctured lung & road rash on my back side.
I had met a low boy about a mile up the road with a track hoe on & thought that maybe he had snaged the line. A county weigh master heard the call & came out & inspected the low boy but he was legal, not even close to being high enough. There was a cement truck working out that way & his tag axle when raised was higher but legal.
Anyway we couldn't find who brought the line down & you could see the marks on the line where it was caught on something. Maybe a low flying ufo. So now we are going after my own insurance co. It falls under a hit & run. A phantom driver, someone brought the line down but we don't know who. It fits under the uninsured motorist part of my policy. I'm not looking to get rich here. My coverage is $25,000 which would cover the $14,000 in medical bills & the $7,000 I lost in wages. My attorney works on contingency so he only gets paid if we win & the other party will have to pay him & court fees.
I'll be glad when this is all behind me, still have dreams of hitting that line. If I was going any faster & didn't see it there is no doubt in my mind that I could have been decapitated.

I keep telling my little brother that motorcycles are dangerous....there are just too many variables and ways to get hurt. I wish he would listen to me.
A couple of years ago my uncle ran into barbed wire strung across a snowmobile trail. He only had minor injuries and was very lucky.

I've decided after 35 years of being lucky that its time to not push my luck any farther. I'm getting into the old fogy stage of my life. Bought a rv, think I'll take up fishing & golf.

Well it was a long day in court today. It took all day & still havn't got it resolved. My attorney did a great job on presenting the case however the attorney for the Insurance co. presented some questions as to whether or not this falls under the guide lines of my insurance policy. The judge was not ready to make a rulling without further investigation of guide lines & law. Ins. co attorney has until Monday to file a brief & mine has until the following friday. So we waite. My attorney said if we come out on top they may appeal because they don't want to set a presidence for this type of case.
Man, 2 yrs is a bit too long to be waiting to see if you'll be getting that kinda money from an insurance company isn't it? They just love to drag their feet on the subjects where there's a gray area don't they?
