exactly- if you would like to read about how the settlement from the trucking company was actually for lost future earnings and pain and suffering (not strictly a reimbursment of medical expenses), or how her husband had to divorce her so that she could get medicaid to help pay for her ongoing care, or how her husband (who is recovering from cancer) is working 2 jobs to try and pay for her care, feel free...... http://edition.cnn.com/2008/US/03/25...tle/index.html does this sound like they kept ANY money that they were awarded? walmart actually sued them for MORE than they got in the settlement.

Good to know, next time we go to contract negotiations, I'm gonna offer up that we get reimbursed the pay-in upon retirement, if the balance is unused. Might make a good distraction when they say we make too much.
Edit, I still disagree with the court, in that a lot of judgements are based on FUTURE consequences in injury cases. $400,000 isn't gonna scratch the surface, if she lives out 10 years. Nobody held a gun to their head to go into the insurance business.
I do know that the insurance company can come after any monies for medical expenses they paid out if you win the law suit.I think the real crook here is the lawyers,if she received 1 mil and only has 444,000 left after their cut! Ouch!!Thats crazy. Also I don,t know how much Walmart has to do with this,its actually their insurance provider that is going after that money,not Walmart the store.I was sued once and had a slam dunk win and my insurance company paid out money to this person and I had no say in it.In my case they said it was cheaper to pay her off than fight and win.
33-50%+out of pocket expenses is the norm in a contingency case. many lawyers will go more towards the 50% if walmart may become involved in the case, due to their reputation.

Good for Wal-Mart. I would be more sympathetic for them if the employees was doing something inappropriate while on the clock and got injured.
