Sam Walton is rolling over in his GRAVE! Not only about this kind of thing, but all of the merchandise from CHINA. He was soooo proud of promoting all things MADE IN THE USA, and now look at the company he built.... sad, so sad.....

Hello,

This at first seem suspect but a lot of facts are missing. Like how much did they get due to other such as punitive damages. Repaying the actual medical expenses back to the policy that paid the expenses once they were won in court after the legal fee's is not out of line. Typically the injured is paid at least 3 time the actual medical expenses plus and punitive damages. Too many fact missing in the media release.

she was awarded a TOTAL of $1 million from the trucking company, and was left with around $440,000 after her lawyers took their cut, and walmart took ALL of it. walmart actually sued her for MORE than the amount she received from the settlement and, being as that she's brain damaged and unable to care for herself, or even remember that her son was killed in iraq, maybe they won't come after her for the remainder of the money.

They make Billions of dollars a day in profits but go to all the trouble of taking back less then a half million from an ex-employee?

You have made the assumption that was the total accounting of the case. This is a major mistake in my experience. If you are correct then I agree but their is a 90% chance your assumption is false. I cannot make any judgement on less than the full fact. Just my experience.

TOTAL does not mean TOTAL of the case. I am involved in court on a consistent basis and what you just witnessed in not the FULL truth. It was just what you were supposed to react to as planned. Remember the news people are professionals providing information that causes you to return to their specific station and no other. They sell hype and emotion. Their is NOTHING stronger than emotion. They are not unlike any other professional trade. It was likely the TOTAL award of the medical expenses. Likely the family made hundreds of thousands to a couple of million in other damages.

I have no compassion for an insurance company in a case like this. They took the contract knowing the workbase the store was dealing with and rolled the dice anyway. If the woman had frauded them, then go get her. She had been determined to be the victim, i/e not her fault, or she wouldn't have recieved the award. She was probably granted that amount in consideration of loss of future income for the family and/or the cost of the uninsured portion of the care required for the rest of her life. Maybe the judge had the right idea to protect Wal-Mart, but they should have sued the truck company as well, not the victim. I don't know of any insurance clause that says, "we are entitled to reimbursement if you suddenly are determined to be rich, and we will keep the premiums that had been previously taken out of your check during your employment."

Although wal-mart is a horrible employer and a huge drain on society, they are in the right here.

Her condition means absolutely nothing, fair treatment for all. Medical expenses already paid, you got to pay them back if you get them recouped elsewhere. Just like every other company.

i have to agree with Don, Damon and Tim on this, and the way it is presented in the news story is obviously designed to invoke a emotional reaction...
I disagree with the principle that the "victim" should be liable for re-imbursement, Wal-Mart should have been going after the trucking company if they wanted to recover their expenses( the principle who caused the loss)..BUT, until the laws are changed, I find it hard to fault anyone who acts within the laws and is within their legal rights.

Before you all get worked into a lather...

Go read your health insurance contracts. Most state that the issuer has the right to re-coup any monies paid out by them from any award you (the insured) may receive. You will have to look hard for it, it'll be buried in the extra-small print.
