Apartment lease & termination

I have an apartment, 1 bedroom, about 750 square feet total. I also have a detached garage, about 10x20 or so. I pay 725 a month. We had our son shortly after we moved in and at first it wasn't too cramped. We had furniture, but needed a few other things to complete the place. Also the more stuff we got for him it has become more and more cramped. We don't use my garage for parking anything in, I just keep my benches and tools, etc in it.
I am a painter and I recently had a customer call me back to do some painting in a rental they have. The place isn't perfect, but it's in pretty good shape, with a yard and an attached single car garage, probably 12x22 or so. It's at least double the square footage we have in our apartment. They said they will rent it for 675. We are really wanting more room now, but I still have about 3 months left on my lease. I know sometimes leases are a pain to get out of, but do I have any options or legal ways to or even some bs I can pull to get out of it without a major penalty or anything negative? I've told my customer I am really interested if I can get out of my lease. Opinions?

Just talk to whoever you leased from and see if they will let you out of it. Tell them you will pay for the add or something and give it a fresh coat of paint!!!

Your apt sounds a lot like mine. I had a hard time getting out of my lease, because I didn't give them 30 days notice. So I have to pay the whole months rent even though I'm moving out on the 10th. It sucks but you do what you have to.

I would just talk to them. All they really seem to care about is if the Apt is full or not. It's all about the all mighty dollar.

Look in your lease. It should say what your options are to terminate.

Did you rent from an individual or a company/complex?

Usually, most lease agreements require you to pay a pretty hefty chunk of change to terminate the lease early. You really should read the lease agreement as I'm sure the terms are laid out in plain English.

I know we like to look at things from only one side of the ledger but for the apartment owner(s), when you signed the lease agreement, they had an expectation that your unit would be rented and bringing in income for the lease duration. I know it's sucks but they're really in the drivers seat on this one.

good luck.
depending on how your work load is, you might offer to repaint a few apartment, or repaint the outside for trade in the lease termination.

Read your lease agreement and see what the terms of early termination are. they should have been spelled out in the agreement. if not, and they try to be unreasonable. point it out and point out they dont have a leg to stand on. Depending on indiana's laws, you might be able to stop paying rent and let them go thru the legal battle of evicting you.

These apartments are very new, so new they're still under construction on google earth. Maybe 2 old max.

I don't want to do anything that could reflect negatively on me, so I would rather deal with them than leave them high and dry.

I rent from the complex, or Buckingham Properties, but I make the check out in the name of the apartments.

I don't mind giving them 30 days notice, I just don't want to pay for a whole month when I'm only going to use a few days. Our actual lease is from 8-8-07 to 8-8-08, so in a way if I gave them 30 days notice tomorrow, it's already paid for so unless I was here 5-9 or later I shouldn't be charged.

The apartment rep is a friend of ours we knew for a while before we came here and she still works here so we may chat her up and see what she can do. Like I said we've only got 3-4 months left thereabouts, maybe they'd be lenient as I'm trying to go on good terms and be honest instead of screwing them 1 or 2 months into the term.

without getting politcal, from what Im hearing with the the foreclosure rate so high, apartments are going quickly and at a premium so they shouldn't have a problem turning your existing apartment around and getting it occupied again.

Yeah every unit in our building is full. Occupancy has to be around 95%.

Go with your thought...

whether you know them or not, it is always communication that sets the tone and any following decisions based on how you act. No need for any eviction procedures...

Landlord /tenant law is about expectations and provisions. No real clause other than 'opt out' with something around a two month fee. Your idea is correct, talk about it. Let them inspect what you have for damage, etc. at their convenience. Not being able to pay is always a realistic reason for early termination of a contract. Less rent is honest, but something that need be known only to you and family. best of times to you, family man. your quality shows!

They may have folks on a waiting list, who know until you inquire. Offer to pay the ad to get it rented until it's rented, offer your painting services. Let them know you can give them "credit" on a painting job in the future (when it's needed if they don't have something needing paint now).

Work with them however you can.

Gonna cost 1600 bucks to get out of it. 60 days notice, one months rent fee, plus any concessions that were given upon move in.....which we got 900 in visas so they want that paid back, but that is unfair considering we use the 900 each month (75 a month) for my garage, and we haven't even used all of the 900 yet.

I was told that if you have to relocate for a job they have to let you out of the lease with no penalties, is there any truth? My g/f's employer may be able to get her a letter stating she'll be relocation for a promotion or something. We really want this place we're looking at, baaad.....but not 1500+ bucks bad....

As a manager of a a place that rents I can tell you we check that stuff out and if you signed the paper to break it that way is theft.
