Need help and advice...

I need some help and some advice, I think that I am left with no option besides to go to arbitration but would like some other peoples experiences and advice. <br><br>2001 6sp H.O. 3.54 ratio 51,000 miles.<br><br>I have had quite a history with this truck. Just do a search for my name in the fourms and you can get a better history.<br><br>Here is a quick one. The truck had missed in Nov. of 2000, I had the A.P.P.S. fail later that winter. I then had problems with lift pumps and in January of 2001, the injection pump failed. By Jan of 2001 the truck had been missing on one cylinder and best guess was that the plunger for #4 cyl. had scored and was sticking shut. Injection pump was replaced, 2 wks later it failed again 'cause STAR would not let the dealer install a new lift pump. 15 days later I get my truck back, (did I mention that then the pump wen out again, I was about 120 miles from home?) I have had nothing but problems since. I used to be able to idle in 6th gear @ 27-28 mph smoothly, the truck now surges after injection pump replacement, it idles smoothly and I can even drive 30 mph in 6th gear with no surging. Not so anymore. <br><br>To get to the point of the post, I am now faced with a dilemma as Chrylser does not want to deal with this truck and it misses when the temperature is below zero. I live in MN and this is a common thing for the temp to drop this low. Problem is STAR thinks that plugging in the truck is the answer. I have two problems with that.<br><br>1. The truck never used to do this and I have started and ran in -15 to -20 temps before. <br><br>2. The truck will miss when it is -15 to -20 below when driving down the road although its not enough to call it a miss, mabye a flutter as the local mechanic called it. STAR didn't address this issue (this is common for me, they leave stuff out all the time). <br><br>What can I do? I have already talked to a zone rep, cannot send it to a Cummins dealer, Chrysler will not pay. I don't think that I should have to pay anything at all, this truck is nothing but a pain in my ***!!<br><br>

Did you manage to keep the warranty service record work orders for each trip to the shop, will the dealer supply you with corresponding repairs in writing that match the work orders completed. Will the DC Rep. give you a complete printed file stating work requested and work completed on file at DC. You may have to go to Cummins and get them to verify with your assistance the problem exists in writing which will cost you a service call. If and when this info is compiled call your lawyer and demonstrate to him you have done everything reasonable to rectify on your behalf, an accurate record of events with witnesses is valuable. DO NOT outright slander the dealer and DC but when asked for an opinion show with accurracy the failure to rectify the problem('s) with your truck. This will get back to them and so will your lawyer-Good Luck and patience is a virtue in these matters- more time equals more lost sales and publicity. PK

PK is right; patience and complete records are a must. In my state we have a &quot;lemon law&quot;, as do some other states, but complete records of failure of the manufacturer to rectify the problem is a must to be able to successfully sue under any of the lemon laws. I have had only one warranty requirement, a lift pump, in 70K miles, and most of us have relatively few and minor problems. Every manufacturer occasionally produces a lemon, and if documented proof is kept by the consumer, legal recompense should be attainable. Good luck.

My dad bought an 02 chevy CK 3500 with duramax for his new truck(I warned him) anyways he put a VA box on it at frist and it ate 3 injections pumps now in ontario if you take it back to the dealer for the same failier 3 times its a lemon we took action the dealer accepted and gave him a new truck same thing he had off the lot brandnew he threw the VA box aside and got the edge juice box. Problem solved and he got a new truck! I think it might have been the VA box? ;D but they don't know that!

Honestly - talk to your local District Attorny's office first. There may be other cases (pending or completed) against the local dealership you can use to leverage before you arbitrate. I had to do this in New Hampshire when my YUGO (go ahead and laugh you Neanderthals) blinker system kept shorting out. I initiated the arbritation process through the dealer (GM/Yugo of America), but followed my bosses advice and called the state DA. Found 3 similar cases (SH*tBoxes err Yugos) falling apart after the waranty expired that were found against the dealership. I contacted the owner of the dealership using the Lemon Law process and this information, and the dealer offered to swap the vehicle with a new one (OVER A BLINKER PROBLEM). No arbitration needed. I realize this may not be exactly like your problem - just do some homework first.

Gee do you think returning a &quot;lemon&quot; you may have caused could lead to Dealers and Company's making life tough on the rest of us trying to work within our warranties? Thanks!

Watch the tones on this, guys. I can see things going south and that's not going to help Jamiebah's situation at all. Please try to keep your responses positive and with the topic of the original post. Criticism is fine as long as you do it respectfully and without sarcasm/negative tones. If you want to start arguments, don't bother posting them on the forum as they'll be removed.

Thanks for all the advice, I gave the dealer one last chance, he is supposed to get the District Rep involved again. I am afraid that I will have to retain a lawyer though as your comments suggest...<br><br>Last week when it started missing in above 0 temperatures, and today on my way to work, (it was over 20 degrees) I tried to pass a semi and the truck just decided to stop accelerating (the temp gauge was over 140, I had been driving for about 6 miles, it was not gelling up), it was like I literally lifted my foot to the point where I would just maintain speed. I was able to get around on the next stretch of road where it was safe to attempt to pass again, but why did it do this? I am sure that the dealer will just say &quot;if we can't duplicate it, you will have to pay for the repair...&quot;<br><br>I wish things would have turned out different, I hate this. I just want a truck that is reliable...
