I got ya beat SoTexRattler,
I was involved in a rear-ender about 6 years ago.
Maximum speed MAYBE 3-4 MPH. That's NOT 34 but 3-4 MPH.
Didn't even leave a mark on either vehicle.

2 years, 10 months later (there's a 3 year limit on insurance recovery after the fact), I'm served with papers trying to sue me for 1.5 MILLION
The woman who was the back seat passenger, was now pregnant (almost 3 years later) and was complaining that she was experiencing Back & Neck pain. Well DUHHHHH! You're "preggers" for Pete's sake.

Insurance company settled for $25,000.
I suggested she name the kid Insurance Fraud.

So all those folks posting about rear ending someone and wondering what kind of aftermarket goodies to get for your truck with the insurance settlement.........beware.

Don't wimp out, as you'll regret it if they later claim YOU hit THEM and there is now hidden damage on their vehicle. Or Heaven forbid, PERSONAL INJURY that "shows up" later!!!.
You can't prove/disprove a thing now as you are long-gone from the scene with no Police report!

Thank God I did have the police there at my fenderbender! The nice friendly driver told me, the cops and another bystander they had NO injuries.. Less than a week later, he was claming all kinds of injuries that could only be made to go away with copious quantities of insurance money!!!!

Sorry, but it is not a nice, reasonable world out there anymore! CYA at all times!!!
Remember,... No more mr. nice-guy!!! Call!!!

Been there, done that...

Thanks guys for the concern, and I did think about going ahead, and contacting the police and having a documented piece of paper for my benefit. First of all "she" the girl hit me, "she" crossed over the line and hit me, weather it matters are not from a lawyers point of view, I know they can twisted things around for their benefit. No license, registeration, insurance, was ever exchanged. When I mentioned calling the cops she did not want to here that, because she knew she was in the wrong. I believe I would have more cause to raise a stink than her, like I start complaining she hurt my back, neck, etc but I'm not because theres nothing wrong with me. This is awful funny though, my wife was in a car wreck two years ago, not her fault, and it was even a major lumber company truck that hit her broad side trying to pass her on the shoulder of the road as she was making a right hand turn. There has been no settlement yet, my wife is on her third lawyer now, the other two were saying that since she has no broken bones and no disfigurement , thats not really in her favor to get hardly anything out of it according to them. Her own lawyers seem to be wanting to rip us off instead of fight for us. We have been paying for every thing the last two years as far as insurance deductables, visits to the doctors, etc, etc to much crap to list. She stays in pain all the time from being twisted, soft tissue damage, with multiple trigger points in her back, disc damage, ete, etc . She will be walking and nearly drop to the ground from her hip popping out of socket and pressing on a nerve. She cannot work because of the pain. 75% of her time is spent in bed now. We are on one income now blah, blah, blah. More than likely I'll talk to the cops some time this week and have a report made.

She was a nice looking girl, not a "hotty" sort of reminded me of my daughter shes twenty-two. I guess she still could be the devil in the blue dress though. LOL.

Thanks for the information though.

Tony

Angry

Unfortunately, too many lawyers operate on the belief that you are innocent until proven broke.

My experience was that many injuries seem to be lawyer induced. The truck that I rearended several years ago did not even have a anyone in it (he was standing by the LR tire changing a flat, IN THE RIGHT LANE OF A 4-LANE DIVIDED ROAD) and I knocked his pickup out from under a load of watermelon. My recollection is that he and the tow-truck driver reloaded the watermelon but later he claims that he sprained his back getting out of my way. Possible but I think his lawyer sprained his back for him.

Hope it doesn't happen to you.

Insurance fraud was the first Texas lottery!
I live in Nueces County, and it has the shameful distinction as being THE most litigious county in Texas.
More bloodsuckers and their ilk have offices based here and branches in the Rio Grande Valley than should be allowed.
They troll for cases like SHOVELHEAD's and worse. They know the Ins Co's will simply settle for some lesser but still >$0.00 amount. InsCo's do that just to stay out of court knowing the jury mentality we have down here... Essentially, free $$ for the taking!

For Example!
Latest Rio Grand Valley Jury trial judgment against FoMoCo was 26 MILLION for a drunk driver driving a Ford product!
Jury said although it was the driver's fault for HAVING the accident, it was Ford's fault the non-seatbelt wearing passengers were thrown out of the vehicle and killed!

Don't EVEN try to apply logic or common sense to that jury's excuse!

Just protect yourself to the utmost in the slightest accident...

Tony,

I can only echo the others in recommending you report an accident when it happens. Several years ago my wife was driving to work in our 76 Jeep Cherokee that we had recently gotten back from the paint & body shop after getting a little work and fresh paint done when she was rear-ended. She had stopped at an intersection traffic light and was waiting for the light to change when she felt a light nudge. She checked her rear view mirror and was another vehicle that looked mightly close to her rear end so she got out to check things out.

The other vehicle was a Pontiac Grand Am with an almost totally shattered front end - grill, headlights, bumper and hood were all pretty badly damaged from the impact. Much to her surprise my wife looked at her Jeep and couldn't see anything wrong at all. The young woman driving the Pontiac was crying and muttering on about how her hubby was going to be so mad at her and that their insurance would probably be cancelled as a result of this. She herself wasn't injured or indicating she was in any pain and since it appeared her vehicle was the only one damaged at all she pleaded with my wife to not report the accident to the cops and just let her go.

My wife, being the compassionate person she is, looked the Jeep over one more time and still not seeing any damage told the other driver she would let it go and not report anything. When the wife told me about it after getting home I told her nicely that we needed to contact our insurance company at least so they would be aware of it in case anything came back to haunt us later. Sure enough, about 4 months later, the other driver's insurance company contacted our insurance company, saying my wife caused the accident and they wanted reparations for the damage caused. I gave our insurance agents all the details of what happened and how her vehicle's front-end was damaged after hitting the rear of our vehicle. Fortunately, the other insurance company didn't press it any further, apparently siding with us once they knew the true facts and realizing their client was lying about the whole thing.

We were very surprised and pleased with the whole outcome, but were nervous about being sued after the fact until we heard their final decision. I was also pleasantly surprised with the fact that our Jeep really hadn't sustained any real damage. I very closely inspected it and did find a tiny little dimple in the paint where the end of the bumper had barely contacted the body and then came back to its original position. Made me glad the Jeep was built as strong as it was. If it had been the Grand Cherokee we now have I know there would have been some real damage.

Anyway, those are my 2 cents worth. Glad you weren't hurt as well as no damage to your truck.

Steve
