I had what your talking about bookmarked at one time, but I don't see it right now. There is a definition of a turbo written into Texas law that defines it as a muffler. Whats written really doesn't matter. It's the view of whoever has the sticker that you want put on your truck that counts.

The Texas Transportation code says:

Sec. 547.604. MUFFLER REQUIRED.
(a) A motor vehicle shall be equipped with a muffler in good working condition that continually operates to prevent excessive or unusual noise.
(b) A person may not use a muffler cutout, bypass, or similar device on a motor vehicle.


And if you go back to the definitions, it defines a muffler as:

Sec. 541.203. EQUIPMENT. In this subtitle:
...
(3) "Muffler" means a device that reduces noise using:
(A) a mechanical design, including a series of chambers or baffle plates, to receive exhaust gas from an internal combustion engine; or
(B) turbine wheels to receive exhaust gas from a diesel engine.


So the definition appears to support the fact that a turbo can be classified as a muffler. But this article I found online shows that Palo Pinto county appears to be asking for an official position from the state on whether this definition really applies.

Looked at the regs yesterday, all vehicles in TX are required to have a muffler now. That's according to DPS web site. Diesels don't have to meet emissions though except in certain counties.

Actually, I don't believe diesels are subject to emissions testing in any county (yet). Here in the Dallas area, emissions are required for gassers but diesel is still safety only.

You have the right to take it to another shop to have it inspected. You will just have to pay again. The computer will not tell the second shop why it was failed. In fact it just gives them a message that says this vehicle is eligible for a free re inspection at another shop but does not give any info as to what shop.
