Getting dipped
I got dipped at a Hess gas station here in town last weekend because i parked the truck in front of the kerosene pump that dispences red kerosene. I just went into buy beer, and when i came out, they were standing there waiting. I do not run red fuel, so i was not worried, but still.
There is a place near where i work that sells clear untaxed/undyed kerosene for under $2/gallon. Thats what i run. I just bring 5 gallon cans to work and fill em up after work on the way home

What about people making their own homebrew biodiesel? Do they tax that as well? Audit your tax returns too?

Exactly, it is not for local jusisdiction to decide, feds say no red on road, locals can add fines, but not make it legal. Even for farmers.

Most States don't allow it period.
Infidel, Montana's fine may only be $100 but the Federal is around $2,000. How you get a Federal fine is from the IRS. I was attending some training in Lafayette, LA about 10 years ago and drank some beer with some IRS agents that were staying at the same hotel.
They where working at the scales on I-10 just outside of town. They dipped every truck that came through. If they found red in your vehicle and you were any type of business, they then sent agents to your business and checked every vehicle you had. They said they got one construction company that had about 10 trucks nailed that day.
It's called Tax Evasion
As someone else said. I am sure that your Tax returns would be Audited very closely for many years to come.
I quit buying red even for my Tractor's. It's easier just to buy all the regular and claim back the Road tax at the end of the year. At least for me. For a real farmer that has bulk storage on the farm, it's simple. Only run died fuel in your farm equipment.

Alberta Canada and Saskatchewan Canada, Farm plated vehicles (including pickups) can run red fuel on farm business, including gas vehicles run red gas.
There have been guys ticketed that decided to take their truck to the curling rink though

A friend of mine in a province that doesn't have this loop hole for farmers was fined $7,000 for running red.

When I used to travel to Montana's Flathead Valley, I would see MHP dipping tanks at the various horse shows and auctions. Then they'd wait until the driver of the dipped vehicle came out and hand them the ticket. It was so much per gallon, plus the IRS would audit the following year - for tax evasion. Legally they can go back 7 years, but mostly it's just to send you a message.
I get 10,000 gals delivered to the farm in the Spring. It's red-dye diesel for four tractors. I have two pickups that have 72 gal aux tanks and a hose long enough to reach the tractor (and my fill pipe too).
The way the EPA set up the rules on the off-road fuel is that they doubled the amount of dye package so you wouldn't be able to wash it out easily. I figured out one time it takes 7 full tanks + 2 fuel filters to get rid of it.
My Dodge dealer in town routinely checks the used fuel filters for dye and often turns in the offenders.
Someone asked about bio? Some I've seen is a dark yellow color. Bio is untaxed and it's very likely what the PA inspectors are looking for.
Who can stop and dip? DOT mainly, but State Highway Patrol as well.
Note: They generally don't stop rv's, which can easily carry 100 gallons. They're after pickups with horse trailers and car carriers crossing state lines. Mostly they ignore everyone else. When you enter a state like mine, with a CDL load, you might be dipped, there's always that chance. So unless you're in the farm or ranch business, with a legit reason to use the fuel on the land, I wouldn't advise driving with it down the highway....the black puff of smoke is a dead giveaway.

Yes, but the law does require the use of TAXED fuel on the roads.
Getting dipped & fined is the risk you run for violating that law.

I would first like to say that I don't run red fuel in either of my trucks. I have serious reservations about the legallity of dipping someones truck either forceably or involuntarily. The only way anyone would dip my truck is with a warrant. I'll gladly go to jail before they will dip my tank. It's no differnt than letting them in the cab of your truck and letting them snoop around. Freedom first. This is not Cuba.
If you're not running red, than why worry about the situation. Look at it like this, they are trying to help you out. By checking to make sure we all pay our taxes in the fuel to use the publicly provided roads, it keeps more people paying the tax, the more people that are putting in on it, the less the burden on each individual.
Went into north FLA a few years ago and the had every thing from semi's to mercede's pulled over and were running a dip sting .
A uncle caled and tipped me off not to go into fla unless I was 100% clean so I avoided the WHOLE state for a week or so.
