Strange Tow/haul issue

Strange Tow/haul issue
My 06 CTD has developed a curious issue after the last time I towed my boat. The truck has about 5K miles on it so far. While towing my boat, I set the tow/haul/OD to tow/haul and had zero troubles.
A few days after I have noticed that sometimes my Tow/haul button will not function. Meaning, I can press the button (while dirivng and in D) all I like but the tow/haul or OD lock modes will not light up on the dash and I cannot feel the tranny's shifts change.
If I stop the truck, place it in park, turn the motor off, wait for a few mintues and fire it back up then I get the Tow Haul mode back.
My only mod it the Edge Juice/ATT and I do leave the stock defuel setting ON for tranny slipage. I have tried removing the Edge but it does not solve the issue.
I should also note the truck is not driving any different (meaning, no detecable mechanical tranny problems or driving problems). Also when I get the Tow haul mode back and the lights come up on the dash I can feel the shift points change and such.
I am getting the feeling there might be a back switch somewhere (meaning I bet its an electrical problem). Any solid ideas before I let the dealer look at it?

I may be mistaken, but I think you have to be stopped before you can engage button/tow haul mode. Otherwise what would prevent an accidental pushing of the button going, say, 90 mph

NOPE--- You can push the button at anytime while driving!! You can also push the button again while driving and make the Trans go into O/D Lockout- - - - - which is REAL BAD at 65mph/70mph!!!!! Sounds to me like there is a glitch in the programming of the truck from the factory-----take her in and let the dealer scan the ecm to see what is wrong! Be sure to take the EDGE off before you do this.

Currently mine is not going into tow haul at speeds from 0 to 50, unless I do the whole stop, place in park, shut down motor (like described in original post). I must have a gremlin somewhere.
