Moron doesn't secure load, I end up with a broken radiator, intercooler and air dam
Last night, some moron I guess was cleaning out his garage, and haul the trash away. Well forgot to secure one of those big plastic crates that you see at CVS or Rite-Aid, and a bag of trash with a jack, tire irons, etc.
It landed DEAD CENTER IN THE LANE on this two lane road. I ended up hitting it dead center on the air dam (naturally broke it, plastic), punched a nice gash in the radiator and the very absolute bottom of the intercooler.
By the time I get turned around, a guy in a new E500 MBZ, ran over the jack, and wedged it under his car for a good 200 ft, ripping apart under his car.
So now comes the repairs.....
Seems that the radiator is dealer-only item....$675.00 bucks for a radiator????????
The air dam is $65 (for .25 cent grade plastic)
As for the intercooler, no reason to install a stock piece. Where is best place to get a aftermarket (BIG) intercooler? As for the Banks setup, I already have a High-Ram, so I wouldn't need that part. What about the other kits?
I am all open to suggestions. As for the insurance, the deductible is $500 bucks.
All because I wanted to go get something for dinner.....most expensive dinner I've ever had!!!!

People tend to use the term too loosely, how much was the machine that made the part? I assume you weren't able to grab the plate and description, huh? If so you can file a police report at least.
The guy in the MBZ called the police, they said that being it was "debris in the roadway", Las Vegas PD would not take a report.
As for the air dam, you would expect at least some kind of reinforcement being that is the front and down low.

I'm surprised they did not ask if anyone had gotten the plate number as they could give the jerk a big ticket for littering and also one for an unsecured load. But then the cops maybe to busy to care as they have way to many wrecks around town to take care of or they did last month then I was in Las Vegas.

When people get into wrecks here, they realllllly get into wrecks. Plus the auto insurance rates here are astronomical compared to Los Angeles.
If the object in the road has stopped moving it is considered debris. If it is still moving, the other driver is liable.
The trick is to say this object bounced out of the back of that guys truck since it was obviously not tied down and was rolling down the road when it bounced right in front of me as I was tryimg to get out of the way. If you can get tag - he is liable for damages to your vehicle.
Now that being said, getting money out of someone in this situation may be another story, but at least he will get ticketed for it and maybe have insurance that will cover you.

almost happened to me last friday on the way home from work. a ford pick up truck in front of me must of had 30 16ft planks in his pick up bed. he had them stacked where they were resting over the roof of the cab and the other end of the planks were angled down in the bed (at the tailgate). he had a good 5-6 feet of over hang over the top of the cab! i assumed he had a enough common sense to have them secured-but i was wrong. i was a good 50 yards behind him-when the planks started to go airborne!! about 20 of them must of twirled a good 20 feet in the air before they came crashing down in the road. luckily they did not hit anyone. they were all over the road. i drove right over them and pulled along side of him and gave him a good lecture about being responsible and considerate of the other drivers. he was an idiot to say the least!
I know how you feel, 17 yearold kid on his way to a party decided to pass me on the left as i was making a left turn into a feild road to scope out a spot to hunt the following afternoon hit me doing 45 mph took out the bedside inner and out rockerpanel and back door . his insurance has the nerve to say it was my fault for failing to yeild when he got the ticket

I had road debris(4'x4' piece of Plexiglas 1/4" thick) fly up and hit the front of my truck square(flat) in the front. It tore up the bumper cover, punctured the AC condensor, cracked the grill, scratched and dented the hood and RS fender, cracked the windshield and broke my RS mirror. All of it was covered under my insurance, minus the deductible of course. It can't hurt to call your Ins. and see what they say.
