I think I have a good case against them. The Texas Dealer Enforcement thinks I do anyway.

After to time spent and the fuel cost to go down to Tx from Iowa, if I had a mind to get the money back it would have to help cover my lost expense---and you know that isn't going to happen.

I do hope you end up with a good truck that suits your needs.

You could include those costs if you file a lawsuit against the dealer, just like you would for a lawyer, court fees, etc.. The way it sounds though this dealer isn't going to be in business very long anyway. Tax evasion and forgery .... wow, these folks are really up a creek. I would be really surprised if they had any money left over once the State gets a hold of them.

Hi Joe! I was a motor vehicle dealer for 10 years. I had a pre-own dealership. I have a lot of diesel experience and that blow by is mostly likely due to your rings are worn. If I were you and having this many problems already, I would call that dealer and tell him I want a full refund. If the dealer refuses, tell him you will check in to seeing if deceptive trade practice has been committed. Wait for his response then let him know that if the judge grants you in favor, he could be paying 3 times more for what he paid for the vehicle. Be firm with him, but respectful. There are to many trucks out there to be spending this much time and heartache over regardless of the power. If I can answer any questions, feel free to pm. Unethical dealers really chap my a$$. I saw being honest with customers got more repeat business and referrals.

The Dealer Enforcement said depending what they find that I could have a civil suit against them.

Hi 6SpdDuallyTX-------Yes the blow by is by #6 being only 200 psi and also #3 starting to go also. The dealer is refusing to work with me at all anymore. So that is out of the question with them. I tried and tried to get them to work with me, but he would refuse to answer any question I had for them in all my emails and so I have tried nicely to give them a chance to come clean and fix the truck even though they say nothing is wrong with it, but the dealer refused to work with me and so I have been forced to go other routes against them.

When we did tell the dealer that we talked with dealer enforcement all the sales manager had to say was "That's ok I know Chad." And when we talked with the owner and told him, he didn't care and said that he would call them also.

So I don't know what to say about this dealer.

Hope all of this all works out for you, I am currently going through the exact same thing on my truck i purchased in january. The dealer just took mine in to check the motor out, but all of the information on here has really helped me build a case against them. Mine does all of the same things yours does minus black smoke at idle.

pmiz05---------where did you purchase your truck, like what state? If you need more help than what you see on here I will be glad to help you. As a lot of stuff I haven't posted on here about the legality details in case one of the dealers friends or worker's is on here telling him everything.

I will let the legal courts and the State of Texas take care of this dealer and see what they find on them. And hopefully they will bury them. This dealer mainly deals in vintage cars but is now getting into Dodge Diesel trucks. So maybe in the next few month's they will be having some super great sales.

i bought it in indiana, but don't want to say anything else right now. The dealer is looking at it right now. they currently ran a dye through the motor and couldn't find any leaks, but sent it to a cummins dealer.

Dealer just called me. they have had my truck for 5 days. They said it was the lower breather was clogged on my truck. they replaced it as well as the upper breather. I don't really know what there talking about, but i'm going to pick it up tomorrow and make sure everything runs good. The dealer did take care of the bill for this repair that was done at cummins in indianapolis.

I just got thee dealers history on charges. WOW.....they have charges going back to 2006 and up until FEB/MAR of this year. For everything they have done to me. But apparently most cases were closed with nothing but a slap on the hand.

And on top of that, the dealer got the Negative feedback I left him on Ebay removed. What a joke.

pmiz05-----hopefully your issue is just that simple.

Well I just got here today and I started it and it idels rough and at 735 rpms on my scan tool. The computer isn't kicking out any codes at all. The tach doesn't jump around at all. I reved the truck up and it cleared up and sound fine but seemed to be slow to return to idle. So I took it for a short drive and it would idle rough or idle fine at stop signs and I noticed alot of white smoke coming from under the hood from the vent tube. And upon hard acceleration with a stock truck and exhaust and all that, should it be puffing out alot of black smoke out the exhaust? It will do it when in park also with the black smoke.

It has insane power, but the rough idle and excessive blow by has me worried that I got taken. And also what the previous owner told me. The under carriage is soaked with oil too, but i can tell the dealer cleaned it up. So I am unsure were the oil leak is.

What do you guys suggest? I am in Carrollton, TX with it for the week if anyone is in the area and wants to help me figure this out. The truck has 248,000 miles on it.

IF you revved it up hard it will be slow to return to idle! You have a high pressure pump that has to drop pressure. My 03 does the same thing if I don't come off the fuel a little when shift to a higher gear. Check to see if it is coming from behind the valve cover also check your oil to see if it has fuel in it. IF so you have you might have a creaked inj or bad rings ==== GOOD LUCK ===
