Angry Desperate need of advise

Heres the deal, bought the '05 on tuesday, carfax is clear, dealer said clear, no prior damage, major work, assured of that fact, today I find that the truck was almost totaled, front hubs fell off when wrecker picked it up, major damage to driver side, in shop for months, what do I do, and what can I do, thanks bunches yall

I'd be pushing for a buy back. Was this a Dodge dealer? Give them a chance to make good and refund your money, otherwise go to the BBB, local district attorney, local TV station "consumer hotlines" etc. Looks like a good case for fraud.

yes it was a dodge dealer, supposed to be the best around, problem is my credit sucks and we need a truck, now, should they find one like or better and switch, or am I just out of luck

I agree, get your money back and find another truck. Go straight to the sales manager and tell them you want to be made whole now or you will get a lawer. Just because you have bad credit does not give them the right to screw you.

Dealers are always out to screw you. Don't ever foreget it.

Ditto...get your money back first....ALL of it (DMV, tax, doc fees...EVERY penny you gave them). IMHO, they are in a bad legal position re fraud & misrepresentation and could even lose their dealer's license. Get this POS out of your life first and then look for another better truck.

PS...it could be an honest mistake on their part....dealers get screwed on trade-in and auction cars too!

update, just got done with meeting with gm of the dealership, it was an honest mistake, all their records also show nothing of the sort, their remedy is as follows
I keep the truck and they:
1) refund down payment, plus $5k for the mess up (I keep the financing and will still owe the purchase price)
2) they extend the bumber to bumper to 50k miles
3)they do a triple check on the entire vehicle including the frame, pull off replaced parts if they were not new and replace them with new
4) if anything is found to be irrepairable they replace the truck for equal or partially greater value
5) fix/replace anything that I beleive needs to be, whether or not it even pertains the the damaged area

They take the vehicle back and refund the down payment, pay the lein(buy back) and pay $5k for the trouble

Quite possibly the best outcome I have ever seen from such a situation. Just for your info, if they pay the lein out on the loan to buy the truck from you then you receive the positive on your credit still. Could be helpful to you in the long run if you decide the truck is just not something your up for. Either way sounds like the dealer is actually NOT out to screw you this time.

....and people trade in wrecked vehicles and the dealers often don't find out about it until later. Don't ever forget it. Viscious cycle isn't it?

i agree with jbody i bet you every one at some point is goin to be or is guilty of trading a in a car or truck they know is about to croak and laugh all the way to the bank in there purty new pickup while some poor sole gets there problem.

Get rid of the truck. You'll have to disclose it to the next buyer and the liability passes to YOU. Take the money and give them the truck back.

IMHO they knew what they were doing. It was not an honest mistake.

On one hand, I'd never want a truck that was that damaged. After that much damage, vehicles are never right. By brother used to rebuild totals. He had a ford mini van that was great transportation but could never get the front end quite right. The dealer can argue that it's all in spec, but it comes down to them wanting to get rid of the truck. You were led to beleive this truck was clean and never wrecked. Whether intentional or not....the outcome was the same: you were misled.

OTOH, If you are trying to repair your credit, I'd negotiate for 100k B2B warranty and let it ride. Afterall, factory warranty for the '05 was 70K B2B and 100k on the motor. Regarding item #2: I assume you mean, 'any aftermarket parts, non OEM.' It sounds like you are getting a pretty good deal, overall.

I agree wit Geico266. Get rid of the truck. If I read that right, you get 5K for your trouble? take the money and run. The liability lies with you when you sell it. You will never get what it is worth when you sell it.
