I've read alot of yor post and I pay close attention to people who have experience in hauling. I've been a truck driver for 29yrs and know the big rigs, but still learning about the ctd. I pull a 12,000lb 5vr have been trying to figure out if I needed to change out my rear end or not.Kind of spendy with a 4x4. According to dc i'am over my gvwr & could gain 2,000lbs with a 4:10. She pulls just fine and don't want to loose the mpg just don't want to stress anything. :-

This is not a new concept. Many vehicles have higher tow ratings with lower gears. Often the "trailer package" includes the lower gear.
The feds do have a requirement that the vehicle can "perform" with the load. I'm not sure what the test is exactly, but it's to keep vehicles from being TOO slow up hills, merging etc. and becoming hazards. I wouldn't be surprised if many vehicles were mathematically calculated rather than live tested.
I've been on some roads in Canada that required a minimum speed uphill, or they could boot you off the road and have to take the looooooooong way around.
That said....with the Cummins and upgrades available either should do the job. As mentioned earlier....calc the RPM's as to where you want to run it in which gear. With the 6 shooter you have choices.

If it pulls good for you I would not change it at all. As I said above, mine has a 3.54 and pulls 30,000 regularly. The only thing that would be stressed more would be the clutch on a hard uphill start.
