Uninsured driver - what to do?
What I can't figure out is why was the driver not arrested for driving w/o a lisence? And the officer should have looked at his insurance card and seen it was out of date or something.... It all seems a bit fishy
FWIW, several years ago, we were in DW s car, out of state, waiting to make a left turn.
Guy in front of us starts to back up. We honk the horn and he stops. Then did it again and hit the front bumper of the car with his hitch.
Pulled off the road and while Im calling LEO, he askes DW "How much you want?"
Got the license number and gave it to PD.
They checked out the address and said no one by the name given lived there.
Had the car repaired in three days and two weeks later, our insurance sent us a letter refunding our deductable and stated they were pursuing legal action against the registered owner of the truck and the alleged driver.Turns out the registered owner had some other infractions and PD had been looking for him anyway.

Be careful that "partial fault" is not assigned to your sister(?).
Was in an accident many years ago. Not my fault, other person turned left in front of me as I was going straight thru a green light. Other person got 2 different moving violations. Accident was probably $100k between vehicle damage and medical bills (a CHevy Caprice going 45mph puts a hurtin on a Geo Metro bearly moving
). My sister and I walked away from the accident w/ $17k damage to a new Caprice (mom's). Geo totaled, both people in the Geo went to the hospital, one in life flight.
Anyway, my parents rates went up as a result. I researched it and found out that our Ins Co. paid out about $4k towards the total accident claim (negotiated with the other parties Ins Co). I was found by the insurance company to be something like 3% at fault and that was the justification for the rate hike.
After that, I vowed to not give out my insurance information at an accident if I felt I was totally not at fault (although they could surely get your info in this day and age). Worked twice. Both times I got rear ended while stopped at a traffic light. One time I got a ticket for no proof of insurance (went to court, got it dropped). Other time, no ticket.
Either way, my insurance company never found out about either accident and my rates didn't go up and the other parties' insurance paid for my repairs.
