I'm so tired of dealing with these insurance companies. It is unreal the crap they will put somebody through.
Last month I had left my shop on a Friday evening to go to the bank before close. Well on the way there an older man pulled out in front of me and took all 8000 pounds of one ton mega cab in the drivers door. As you can imagine he was unconscious when I got out of the truck (my air bags did not deploy). He never responded to anything and had a very weak pulse. He was later pronounced dead. I think it broke his neck.
Fast forward a few days. My truck is sitting on a local tow yard. I have no insurance information from the other driver, there is no police report (I'm told it will probably be three to four weeks before there is one), and they will not release his insurance information to me until the police report is released.
So I call up my insurance company to start a claim and get the ball rolling on the repair of my truck. Come to find out I don't have rental on my policy, and it will have to come out of my pocket until there is a police report to say he had insurance or he didn't. No problem.
Well three weeks later I get a police report and he was found to be at fault, and he had insurance. So I contact his insurance company to file a claim. They said no problem getting the rental car pain for. And they will just cut my insurance co a check for anything they pay out to fix my truck.
Fast forward to this week. I call to see if I can get a truck rental. The lady tells me no, and we won't be paying for you current rental. I about flipped out. Well I got another lady on the phone who tells me that once I have the final contract on the rental they will see about paying for it. But chances are it's a no. She says their policy is that if they are not in charge of the vehicle repair they do not pay rentals. Bottom line. After I explain to her the circumstances of the accident she says all we can do is submit the claim and see what they say.
So this is my question. Do I wait to see what they plan on doing or should I go ahead a get a lawyer involved in this? My rental bill is going to be close to $1000 by the time my truck is ready.

Have a good talk with your insurance company. They might have lawyers who may be able to recoup the costs. I don't know if it's possible, but if your insurance pays the bill for the rental then go after the other insurance. Afterall you still have to get back and forth to work don't you? Lost wages?

I don't know why they aren't. Other than I don't have rental coverage. They keep telling me it's between me and his issuance co.

I've been in your position SpeedyWS6, and as much as I hate to say it, HIRE A LAWYER. These insurance companies will drag you thru the mud just for the sport of it and you'll be no further ahead when they're done with you.
most insurance comp. are not willing to supply you with something that you didn't want from your own insurance comp. If you had paid for rental on your insurance it would have been a non issue, the other guys ins. would have paid for it.. you see my point? Insurance companys are pretty much straight forward because there is alot of compition out there

But if I had been able to file on his policy immediately they would have to provide me with some form of transportation. The only reason they can give me for not paying is that they are not in charge of the repair of my truck.

Can you go after his estate, maybe then a family member handling his assetts and vehicle will be inclined to lean on his insurance comp. as well.
I would hate to do that to them, but they did lawyer up already. I'll be in contact with a lawyer Monday, but I'm still only going after insurance co.

Ordinarily I do not like to get a lawyer involved. I feel that if we had a few less of them the world would be a better place to be.
But under the circumstances I recommend that you get one on your side and fast.

Contacted my lawyer this morning and he pretty much told me I'm SOL without an injury claim. The pot won't be big enough to peak anybodies interest.
So I left waiting to see what the insurance co does, or I can go after the guys estate.
