If it where me I would probably make the payment to cover our butt and then do what Geico266 suggested.

Update

Been a few days but wanted to let everyone know that it was a dealer mistake and some how my payoff 'Slipped' by them. Either way the dealer made it right and made an instant ACH payment to Chase and sent a letter of explanation to Chase all of which I was sent copies of. so right now everything seems to be taken care of. Spoke to Chase and the account is closed and there should be nothing that ends up on our credit because of all of this.

Now if I could just get the dealer to pay up to fix the front end vibration issues.

One final step: Check with those big 3 credit reporting agencies in a few weeks to make sure nothing slipped through to them, while all the details are fresh in everyone's minds.

This is just me but if I were in that situation I would pay the payment so that my credit isn't affected, and then I would take myself down to that dealer and post watch over the manager's office door until he either came in the office or came out of that office and I would demand immediate payment before I started to Lawyer up. I would not take this lightly as this ridiculous action by your dealer could affect your livelyhood.

EDIT: I just read your last post. Sounds like you got things taken care of. I'm glad it worked out for you. I know for me, I would not have been happy about that at all.
