Accident and insurance settlement
I know most of the basics, don't settle on the the medical until you're sure, don't sign anything right off, etc...
My wife was rearended yesterday morning, totalling our 95 Audi. She got some bumps and brusies on her forehead from hitting the steering wheel and she's home today as well with a partially swollen shut eye. She went to the ER and was checked out. The MD seems to think there's no neurological damage, just some bumps and scrapes. I know we are entitled to all medical payments and pain and suffering. I know that we are entitled to fair market value for our vehicle.
The issue is: their insurance and our insurance are the same company (State Farm). Maybe even the same agent.
What sort of run around should I expect to get. I'd rather not hire a lawyer unless I have to. SF has already said our medical will be taken care of thru our comprehensive policy. But am I stuck with a take it or leave it and sue situation for the other stuff??
I have a very good relationship with my agent. I've been with him for about 20 years, have all my policies with him (homeowners and such) and he is a decent, fair person.

I'm curious why your medical is covered by your insurance. All expenses should be covered by theirs. But, if the accident wasn't your wifes fualt until the other peoples issurance runs out you should not have to put a claim against yours.
In AZ they "can't" (but it still hapens, amazing how regular rate increase hit me but not my someone that lives next to me) raise your rates for something that wasn't your fault.
As for what you get, that is greatly dependent on who you deal with at your insurance co. Personal example: in May we bought a truck and procured GAP coverage through our insurance co. 29 days later it was stolen, three days later recovered as a total. That caused me a great deal of heart ache. Finally I told the appraiser and my agent I was going to the state AG and turning them in for fraud concerning the GAP cpverage. I started shopping for a new company after that. Prior to finding a new one (about a month and a half later) my '99 was broken into and attempt theft. There where some issues with the repair shop, but the Insurance was exemplary. I think they had an internal issue with the adjuster but the supervisor took over and caused no issue with my claim. I even got to the point with the Body shop that I called my insurance and told them I was taking my truck back regaurdless of condition and it would get fixed somewhere else and they completly supported me.
Before sueing ask for the suprevisor. Go as high as you can and you may find someone that is good to deal with. If there is something that is not covered that should be don't back down.

Good Luck with State Farm! I was with them for over 18 years until I was backed into broadside by another SF customer. It took weeks of calling and complaining and they tried to turn my damage in on my policy saying they couldn't establish 100% fault since it was on a private parking lot! They would call me, keep going over my statement(it never changed) and finally I hinted around about going to someone else for help outside the company and wow I had check in my hands in 2 days and the truck was fixed like I asked. Just don't threaten to get a "lawyer" then they usually stop processing and wait for your lawyer to make the next move and then they will really drag their feet! That is just my experience with them and I no longer use them, agent was great, company was a "pain" to deal with. Good luck and don't back down.
