Got big Problems and dont know what to do....

As most of you know I just bought a truck ( In sig. ). I have had the thing for around 2 weeks and have only been able to put 150 miles no it and those were on the ride home from when i bought it. Well before I got it home the head gasket blew. Bummer but not realy a big deal. Well I took it to Scheids and they tore it down today. Well I get a call this mornign and when the took the head off the gasket was blown and something even wors was wrong, 2 pistons were scorched. Well the also took the injectors out sence they took the head off to make sure they were ok, well thay cant even find out what they are. They aren't even sure if they are dodge diesel injectors. The weird thing that I havent gotten is that this engine has only 3,000 miles on it, how could it get 2 scorched pistons in that time? Something is very fishy with this truck, I am not even sure yet what but something is. Either the engine isnt the new one and the PO lied or he knowingly put in a bad engine. I know I am going to get it fixed and that just has to be done. What stinks is that I am not sure if I should talk to the PO and ask whats up and try to get some money back from what I paid for the truck or just sue him and get all mymoney back. I know I didnt do all this damage and need to get to the bottom of everything.

Any one know the $$$ that I am looking at to get things fixed? Going to put in some 370 injectors and they said they have to hone the 2 cylenders and replace the pistons. Not sure if there is more than this wrong but they will tear down the engine today and find out.

Any sugestions on taking him to small clames court or something else? anyone been in this position?

If you bought it used with no warranty, there is not a thing you can hold the PO to over this bad deal. The term "Buyer Beware" pretty much sums it up.

Sorry for your troubles but anytime you buy used, you just might be buying somebody's headache as well. You roll the dice and hope for the best. This is why you ALWAYS want to take a used vehicle to a competent mechanic to check it out for you BEFORE you purchase.

Paying him a few dollars to do so, can save you thousands later

Good luck on getting it back together without too much pain

It's not going to be pretty. Sorry to hear about your problems, Lary pretty much hit the nail on the head though. Never can tell about people, maybe he didn't know better, maybe he did?
I would want to know who did the work (you say the engine only has 3K miles?) Maybe the PO can help you out there? Some folks offer a 12 month 12K mile warranty on rebuilds.

On the small claims thing, you would likely have to PROVE that he grossly misrepresented the condition of the truck. (Did he?)
A common response to this is going to be, "Hey, he bought a truck with X amount of miles, it is NOT a new truck"

Precisely why I don't buy used anything anymore. Nobody takes care of stuff anymore and maintenance seems to be a four letter word.

PO vehicles leave you nowhere to go. If you buy from a dealer then you have 30 days warranty or not.

Sorry for the bad luck. I guess you'll be bombing sooner than you thought.

Ever heard of lemon law????

Does your state have one of these???

If you can absolutely prove that it was a bait and switch you could still go after him and i think you have some leway time whe n you buy a vehicle privately, not too sure. if anything get all your ducks in a row and talk to a lawyer before proceedeing with a lawsuit.

Well just got a call from my dad who went to scheids to check eveything out. they are now sayin 3 pistons are bad. Htey are going to start and tear the whole engine apart and check everything on it so this doesnt happen again. One thing that is weord is they say that the hx-40 is too big I realy dont get that. The injectors are the big problem in this case. They are still tring to track serial numbers to find out what they are. The estimate was around $5k and i guess that is with all new pistons and fire rings and all the works.

I can make a case in small clames court with everything I have. I have the add he placed that says its a new engine and has all this new stuff. If none of this is true its an open and shut case. He lied and sold a bad product. He hasnt been able to come up with any recipts other than lift, tires, gasket and some other small stuff. I would just like to sue him for repairs and that would be fine. If he come up with recipts there will be a product warrnety on what was put on then that company will have to pay. I guess I will just have to wait and see when all of the dammage is tallied.

I guess if I dont get him God will

Look at your reciept, does it say, "Sold as is"? If it dosen't, you have a case. If it does, you don't.

As is , where is , won't hold up in court, neither will almost any waiver you have ever signed.

I bought a CTD once , appeared in good shape to me , got it home , had to re-inspect it (bought it in a different province) , and it did not pass , ran the VIN , it was a salvage vehicle.

I called the PO , gave him his options 1. Buy it back, 2. Pay to fix it.

My receipt clearly stated as is where is , and he knew it , he tried to weasle out. I told him in no uncertain terms that he was to fix my truck , or buy it back , as i had stopped payment on the cheque... Which did not work out , i didn't get the stop payment filed in time. but after some rather heated conversations, and threats of legal action on my part (he sold an unsafe vehicle without disclosing information, and he too had no receipts for claimed repairs) He agreed to buy it back.

DO NOT take no for an answer , he represented the vehicle as having a new engine , if it does not , he owes you a new engine, and to cover all other associated costs. If it is a new engine , whoever did the work will have to come good. If this won't happen , make it PERFECTLY clear to him that you will accept nothing less than a buyback.

To tell ya the truth I do have a case with everything I have saved. 1. an e-mail that lists eveything he has done including a new engine. 2. Kent Crowder is working on it right now and said he doesnt see much of the stuff i have told him was "supposed" to be on it. He also is going to look at the clutch and drivetrain to see if that is what should be there too. He says one of two thats happened, rither he never put in a new engine or he knew the engine was damaged and put in anyway.

All I want from the PO would be to pay for the repairs, thats it. I want to keep the truck but dont want to pay the 5k to get everything back to what it should be and was supposed to be. Bad news for him one of my uncles is a judge and another is a lawyer, plus my mom works for a congressman. So i guees I have a big advantige.

Hope everything turns out good for you, Kent is a good guy, he did all of the head work on my truck, I'm sure you'll be happy by the time it's all over.
