Wink basics.....

for what it is worth ....

I have heard lemon Law cases (GBL 198 New York) for five years. DC will have the same attorneys for that area, and you may have one to three arbitrators work that same area.
BUT! The law is the law and in Lemon law cases you have to meet only five points of the Law, for basics, very little states differ.

less than 100,000 miles. personally owned vehicle and purchased in same state as residence. no void warranty work or improvements.
Dealer has been notified and has had the opportunity to "cure" or fix the problem. most will say they cannot replicate the problem. make sure the work order states what you have trouble with- if engine noise is too basic, list tapping in crankcase, etc. that sort of thing. be very nice to the shop foreman. no need to scream on him, usually he knows what is wrong but the car companies won't fix it.
three opportunities for same problem: once they changed the oil and said you are all set. next they replaced a sensor and said , it's all ready to go.- that sort of thing.
multiple problems that devalue the vehicle or render it unsafe.
take it to another dealer and say you want to trade it in, it has (engine noise, vibration over 40mph, leaking rear window and steering wobbles after a pothole) have him write down a price of trade in. that's is a good proof of value for your case.

Lemon Law only has two options. replacement vehicle or final value cost.

you can try to regain your old truck BUT most likely they will say it is gone.
the cost will never be close to what you laid out for the new truck, expect that.

replacement vehicle can be negotiated with a different engine (5.9) or close to a value. work with the dealer in private , not at the hearing. most arbitrators will excuse themselves if it is a settlement offer. some states do not allow this option.

you do not need a lawyer. it is solid advice to retain one however, for the cost recoveries. nothing other than the vehicle or first needs of the vehicle are included. go to small claims Court for that stuff less than 3,000 dollars basically. working with the dealer for what you want and would like to continue may work. DC will not be helpful. figure your truck will have been abused as a basic statement of value from that side of the argument.

hope this was helpful.

I don't have the tick but everything else is going wrong. I bought the truck July 3 and it has been in the shop for 15 days now and is going back tomorrow for a couple days. This time it's going in for another turbo. The first one was replaced at 2500 mi when the vanes disentegrated then at 7500 mi the actuator went out. In Kansas I have to be out of my truck for 30 days in one year from date of purchase before the ag will even look at the case. So far all dodge has offered is to extend my warranty for free.

Another thing ... you did not specify what type of truck you have (2500 or 3500). In most of the states there is a 10,000 GVW limit to be considered for the Lemon Laws. If you have a 3500 ... you own it ... ffor-ged-aboud-it unless you live in Washington state where the limit is 19K GVW.

You made a mistake telling them that you were looking into the lemon law. My brother had a '06 Colorado and after he had it in the shop for at lest one day every week for the first two months for the same two issues. There records magically diaspered, it was a good thing that he had all copies of each service and rental receipts. It took three months to get them to buy it back from him and he had to fight to just get payoff for the truck. The bad part was that they put it on the lot the next day after they bought it back and re-sold it to some poor fool. He just got a call from the dealer the other day saying that they finally figured out the problem, bad rear beake drum or something like that. It only took them and I quote "35 times and we finally figured it out"

I hope that it goes smoother for you than it did for him, he said that if he ever buys a new truck again it will be a new CTD.

I hope your truck will run w/o probs now. I had my truck at the dealer 3 times for the same problem within the first month and 2200 miles. It's been fine for a week now. It sux to feel like this about a new truck. . .

Update on lemon

Ok, just had tech from chyrsler look at my truck today regarding engine rap, he just called and spent 1/2 hour explaining what he had found. Truck is rapping due to fuel delivery, to much fuel is being deliverd (pre detonation) due to a exhaust temp sensor (EGT) being faulty, they will have new part in several days. He was very helpfull and explained everything just like he new what he was talking about!!! He also said for all my troubles they would give me a extended warranty FOR FREE!!!!!!! I hope this is gonna work out. All u people who are having issues , hang tight, they are working thru these issues
