Verdict For Failing To Fix Known Transmission "Park-to-Reverse'' Defect
but I am a little tired of people suing large corporations for doing essentially "bone-headed" things. This is like the MySpace lawsuit last year, or the $3 Million to the old lady who spilled the Mc Donalds coffee. What happened to being accountable for your own actions!!
as for the park thing, how many threads have there been on here with people griping about the honk recall and how unsafe the reverse thing is. i have a friend who sold his dually purely becasue dodge wouldnt fix the park thing right and he was scared to hook up his gooseneck bc it had popped outta park before on him.
I guess the REAL problem has more to do with an ATTITUDE that says you have to SUE them to get something taken care of right, and hopefully no one will die in the process. It is a shame things have to go to the limits they go to isn't it?
More than likely what needs to take place regarding the FIX for the PARK problem is a class-action suit by those who own the auto tranny and have concerns regarding the possibly GRAVE situation. All it would take is probably the filing of a mass-claim to the DOT Safety people/or who ever you would file it to, and the filing of the class-action suit against both the DOT (for not demanding the right fix) and DC (for not doing the right fix) and naming the current fix as a safety hazzard in and of itself.
I know I surely would get rid of something as unpredictable as this tranny problem could be, hands down it would be out of my life or out of my driveway.
With regard to the steering problems in the 2006 trucks, I do not have the type of steering play, but I do notice I have to steer more in one direction over the other. I am not sure if that is the road surface/drainage angle or the steering box. Maybe we need a poll that encompases these issues to get a better idea about what's going on with the steering box?
I do recall reading about the 'intention' of McD's, and there was also some studies cited in the trial that discussed the temps being so high as to CAUSE the type of damage done that McD's were well aware of and disregarded - Many states actually HAVE laws regarding the temps of beverages being dispensed to customers, and I believe that this was also the findings in the case and subsequent actions because that state DID have laws about temps and McD's was also found to have disregarded the state laws. To me this 'frivilous suit' brought McD's back into reality, and probably saved a lot of other people from being injured because of their 'intent'.
Maybe the awards DC's insurance carrier will have to pay out will be the impetus for DC to get the tranny's right - the carrier does have the power to make them make changes and also fix what's out there before they have to pay more out if repeats occur. To me, that's the benefit of the case to all parties indirectly concerned as owners of the same FLAWED tranny.

I guarantee that she never once (before any court preceedings took place) ever even thought that she was responsible or that she was careless or reckless or even negligent. To me, that is the real problem; no one will take RESPONSIBILITY FOR THEIR OWN ACTIONS!!!!!

I always set my parking brake on any of our personal vehicles. It has a been a habit ever since becoming an auto tech. I just hate replacing frozen parking brake cables as it always happens where someone will try and set the parking brake cable the first time after thier car has had 75K miles on it and then everything locks up.
As for Dodge I do think the have ignored the vague shift detent that they have in place. I always if leaving the truck put it in neutral and set the parking brake down hard after hearing so much about this problem. Mine has never jumped out of gear. I more than likely just shut the truck off though if running into the local 7 eleven than take the risk of leaving a vehicle running for more reasons than it jumping into gear.
It seems to me on the surface that a person should be more accepting of the responsibility of thier actions when getting out of a vehicle with it running. Lost Texan, my steering is still as tight as new with 17000 on the ticker. I have used the e-brake from day 1 only because I do not like the "torque lock" on the tranny when parked on a slight incline. Even on my slightly sloped driveway, I use the e-brake and it moves into gear real smooth. My wife's Armada bangs hard when she puts it in reverse after parking against block stops in the garage. edited by admin I said "Honey calm down and release the parking brake" She hung up on me. Oh well, I know it works.

I just got another recall notice in the mail the other day... There is a problem with the transmission and that stupid honking horn is not going to fix it!!>.
Just yesterday I drove to work, put it in park and set the parking brake and let the turbo cool down.
After work I cam out and the shift lever was still in park and the truck would not start.. I looked at the indicator light and the trans was in "R" with the shifter in the park position.. I had to pull the level down and back into park to start the truck...

That would require spending money to un-screw the problem, and also a sense of corporate responsibility to make their engineering mistake right. Considering DC's track record with injectors, death wobble, blend doors, cheap u-joints paint and sheet metal, and the wholesale abandonment of 6 years worth of manual transmission trucks, I wouldn't hold my breath.
mustve been on a fairly steep grade for this truck to be moving with enough momentum to kill him! maybe DC should counter sue that he was too stupid to use the parking brake. Its not a decoration! besides it being safe it saves a lot of stress and tear on the tranny and shifter

This fellow was not the only death incident and there are quite a large group of people who have been seriously injured. There have also been some people injured in a minor way, and some of all of them also used the e-brake. This is information from testimony in the case that was discussed on another forum and there was no link to it so take it as you see it.
Regardless of how frivilous this suit and the jury finding seem to some, the REAL fact IS that there needs to be a REAL FIX not just a honking horn. As these trannys age it may be that the repair to fix this could get real expensive and once a warranty period is over this expense will be the owners responsibility. I would be looking at DC to get this issue repaired on my warranty and they are looking to pacify you until you have no warranty. Those who do not have the problem now may have it in the future. Better to band together and push DC into a recall and fix on their watch.

You can stop your statement right after the word "manual". Most people don't read it at all, about anything. How many posts do we see on this site from newbies asking stuff like how much oil does my truck hold? How much fuel is left when the low fuel light comes on? How do I turn off the seat belt dinger? ETC,ETC. Those who know those answers are the ones who HAVE read the manual. Those who don't are too lazy to read it. We should start responding to those type questions with a stock answer "Ask again AFTER you've read your owner's manual cover to cover. There will be an exam".
