So does anyone know for sure if farm offroand diesel will ever be ULSD............. If its not i have access to it legally

 

The answer is yes............Soon there will be only ULSD, dyed (red) for Off-Road Use Only (no highway taxes) and clear for On-Road Vehicles (taxable). Don't get caught with dyed diesel in your highway licensed vehicle. The fines are stiff. Strange as it may seem, the IRS is the enforcing body for these violations. The commercial trucking industry has been targeted for "spot checks" at truck weigh stations. Especially trucks that have access to Off-Road diesel; i.e., logging trucks, dump trucks, heavy equipment movers etc. I am told the fine is $10 per gallon for the capacity of the fuel tank. Hence, a typical 120 gal tank would bring a fine of $1200, regardless of how much fuel is in the tank. I don't know of any case where a private party has ever been spot-checked with his pick-up, but I guess it could happen.

 

I have! An Alabama State Trooper pulled me over on the Interstate in Birmingham to dip my tank. The fuel in the pickup was green, the off road tank red and that was it. He did give me a pamphlet and when I asked, explained that the IRS would audit anyone "caught" using non-taxed fuel in a taxable application.

 

There is a Shell station down the road from where i live that sells premium diesel and it is about .10- .15 cents a gallon cheaper than the rest of the stations in town and i can tell a difference in how my motor sounds and runs when i run the premium fuel
