Transmission Shudder ???

On a slow acceleration I feel a shudder up to about 1-5mph. Its an Automatic 2 X 4 with 40k miles. I had the tranny serviced and they told me it was overfilled and foaming and maybe causing the problem but they could not get it to do it when it was there at the dealer. Well I was upset that it was overfilled by another mechanic and for not checking it myself after it was completed. Now I'm thinking it is fixed but today it did it again slightly. At full operating temperature it was more obvious then when cold. Did I mess up the tranny by running it overfilled for about 1K miles or is this the shudder issue that the 48RE is known for as the dealer told me. I never had the problem before. Anyone have these issues?
