DOT regulations on mufflers!!
you fall under the laws where you are trgistered if their is no fed law. up to about a year ago texas didnt require a muffler does now. brother in law was stopped in tenn a few years back and giving a ticket for no muffler proved it was legal in tex and ticket was dropped fight it or question it to the judge
If it's striclty an equipment issue, then you're right. You must meet the regulations of the state/county that the vehicle is registered in. If your county doesn't specifically state you must have a muffler, then you're clear of the equipment violation. If the cop isn't smart enough to also write a noise violation, you're clear.
That's what made me mad about the first shop I took the truck too, the manager could not figure out why I was ****** he failed the truck because it had no muffler, yet some snot nosed punk's honda civic with a muffler was at least twice as loud at idle than the dually passed no problem. Sure am glad to be back in Wyoming, no stupid laws regarding modifications.
here's my .02 I work in the HVAC trade, and have to know a little about plumbing, electrical, and framing, along with gas, refriduration, and duct work. And in all the class's i have attended they couldn't stress it enough that it doesn't matter what the national code, or state code is, if the local city code calls for something, thats how it is. for exaple...(if you live in utah) national DOT accepts the turbo as a muffler, Utah also accepts the turbo as a muffler (not really, but for example), but salt lake county says you need one then you need one to pass saftey and IM. it all depends on the local laws. I would personaly just get a muffler cut the top open and gut the thing and run a pipe through it, then when they look you have a "muffler"
I checked out at a garage here in PA and i was told that anything that is not original like if the truck was factory with a muffler it needs to have one to be inspected. same for a cat.

Fed regs are just that, federal. Each state/ county/ city is free to make up their own laws on top of that. What matters is where you are driving through, not whats the law where you are "registered". Joe, when did you get that, thought someome else was getting it for you?? Back in June, I was popped for defective mud flaps in Texas. After a 45 minute search of my truck ( the "03) I was set free with a warning ticket. If caught again in that effed up state for the same , I "could" be cited into a court of law for $375

Somewhere I read where all duallys are required to have them, I cannot remember where I found that read, too long ago, but there is some DOT law about them.
IF you have mud flaps, then the laws talk about keeping them in good condition/working order. If they are torn, have holes, missing on one side, etc - that is the 'defective' definition. This usually gets a 'fix-it' ticket that gives you something like 10 days to repair and have written off at a STATE POLICE office.
A couple (three) years ago there was this BIG BUZZ about cab clearance lights, seems the 3500 DRW's had them stock, the 3500 SRW's did not. All said and done, Chrysler lost the battle and had to put them on the SRW's as stock and I believe they contacted owners with the SRW's about getting them installed at no cost to meet the DOT mandate. I think that the mud flap requirement will have the same effect when all is said and done, meaning that the DRW's will have to put them on. In a technical sense, if your tires throw mud onto your rockers when traveling in a straight live, then you need mud flaps, or at least that is where the DOT seems to stand on the issue.
I think it was last year that Albuquerque passed some very strict stuff about mud flap requirements, they claimed they used fed DOT laws as a basis for their requirements. IF you get a stone chip/damage from any truck in this state and you get the license plate number, then the truck gets called in for a mud flap inspection, if your truck doesn't meet THEIR specs, ticket plus you have to pay the damages to the other vehicle. I have NO idea how this is working out, but somehow it DOES go to safety and the state laws here support your safety responsibility to other vehicles.
I have mud flaps on my SRW to protect my vehicle from stone chips, etc - too many of our roads are dirt/gravel no to have them.

If that was tryue then anyone came here to Texas would get a ticket for not having a front liscense plate or inspection sticker if they didnt have them. i was stopped by Iowa DOT 2 yrs ago and he made the comment that my truck was real loud was straight piped which was legal in here at the time and told him that the turbo passed as a legal muffler at the time and nothing more was said about it
I come from NM which does not require a front tag. However,I was given a ticket in CO which does require a front tag. Granted, the cop was an A$$ from the get go, but they do apparently have the authority to issue such citations.

It would seem to me that other states would have to recognize that YOUR state doesn't require a front tag, therefore they'd be way out of their jurisdiction to be EVEN WRITING you a ticket?? I CAN get into the fact that they have jurisdiction over their plate requirements, but other states?
What did you have to do to get this ticket straightened out? US New Mexicans are going to have to carry some copy of something to PROVE our state laws and only a single rear plate??
I look for NM to go to the double plate/front and rear, just to comply with the other states before all is said and done. There are several states that have rear plates only. I suppose it will serve to INCREASE our registration costs?? We don't have what could be called a commercial plate for our trucks here either. My plate looks the same as any other AUTO plate, the difference actually is stated in the vehicle gross or the registration. I suppose the next problem will be getting a ticket for a non-commercial plate and the gross weight class stuff, eh?

I didn't have the time to stick around and fight the ticket......I paid it and went about life. The cop did tell me " I don't give a da** what your State requires....we require front and back plates here."
