Dealer Did NOT pay off my Trade in!

Dealer Did NOT pay off my Trade in!

So my Wife and I traded in our 05 Ford Expedition back on 8/2/07 for an 04.5 dodge ram 3500. Yesterday I received in the mail a late notice from Chase for missing the payment due on 8/22/07. Sure enough I call Chase this morning and find out that the account with them is still active and that Im 20 days past due . Now I've contacted the dealer and asked from the general manager and got his voice mail and left a message.

The new truck and the Expedition were both under my wifes name and she's got near perfect credit...what is this going to do to her credit since its the dealers problem??? What action should I take against the dealership?

Oh yeah and the Expedition is on the dealers lot for sale right now.

Any help would be greatly appreciated.

the dealership should take care of it! contact the finance manager and ask him what the hold up is on paying off your trade in

I would go to the dealer and talk with the finance manager, they usually handle that paper work. As far as her credit goes, once it hits the 30 day mark it will automatically get reported, so it will most likely bomb her credit score. Ask to see when the payoff check was sent out, and get a copy of it and the payoff amount and the person at Chase who the dealer had been in contact with, it could be a problem on the Chase bank end of things. If it was chase, then they should correct the error and repair her credit.

good advice^^ i forgot to tell ya to get in touch with chase and let them know what the deal is. when i traded in my old ride, i had a similar issue come up, and i called my credit union and they were very understanding...i also bugged the fiance manager until everything was resolved

When I traded in my old powerstroke for my dodge, I kept an eye on my account to make sure it was paid off so that same situation didn't happen. 2 days before my payment was due it still hadn't been paid off, so I called my credit union and they told me to go ahead and make the payment and they would credit me back my payment after it was paid off......that way my credit didn't get screwed!

Chances are someone dropped the ball........I'd just keep contacting the dealer and Chase to see what they are going to do. More than likely they'll fix it and you'll be good to go.

it took them a while to payoff my trade too, i watched the account they waited until the last day

If it's only 20 days past due then it shouldn't affect her credit at all. Finance companies "generally" don't report late payments until they are over a month past due. You have already contacted Chase and they are now aware of the situation. I figure that they have flagged the account with the new information that you gave them and this should stave off any chance that they might report it. Both of my car payments are due on the exact same day from the same financial institution. Not too long ago I sent both payments in but about 3 weeks later I received a notice that I was late on one payment. What ended up happening was that they applied both payments to one account and that made the other look like it wasn't paid for that month. When I called them it was pretty easy to figure out what happened and easily corrected. I also asked them about my credit (I have perfect credit and didn't want to mess it up) and she said that they don't report it as late unless it is over a month past due. I have heard this from many other financial institutions also. I would however follow up with Chase and the dealership and stay on top of the situation (which it sounds like you have). Probably an honest mistake.

Update

As of 2:20pm 9/11/07 no one at the dealership has returned my calls. I've not been able to actually talk to a live person other than the secretary for the owner of the dealership. I've left messages for the owner, general manager, and finance manager.

I've also found out that the Sales Consultant that sold us the car quit working for the dealer 3 days after we purchased this truck. The Finance Manager that we dealt with for the finance portion, no longer works for the dealer.

I've had my wife call Chase and flag the account and I've faxed the documents to Chase to prove that the car was transfered to the dealer on 8/2/07. I'll be making a trip to the dealer after I leave work to deal with this personally. If I cant get a satisfactory answer from someone at the dealer this evening I'll probably go ahead and make the payment to Chase to cover my butt.

Thanks for the help and I'll keep you all updated on this.

Don't even bother calling them again. Call your state attorney general office on automotive fraud and file a complaint. Contact your state licensing board for car dealerships and file a complaint. Contact the BBB and file a complaint. Contact the Dodge regional sales office and file a complaint. If they don't pay it off by Monday call an attorney and file a law suit.

You have tried to be nice and ask them directly, now it's time to get serious.

Do the right thing and cover your butt... Better to get a refund than to get credit ruined. Good thing that you caught it early...

Just had a secondary dealer here in San Diego go to the can recently for the same thing. He just kept all the funds and destroyed other people's credit to do it. I think he got 5 to 12 years.

id have that places reputation in so ****-poor shape they wouldnt be able to give cars away and i would start with all of that, being nice will get you no where, cut their legs out from underneath of them. I wouldnt wait til monday, i would just have the attorney show up at the car lot with me and serve them the papers personally. yes i know, im a dick.

I was watching the news last night and saw a similar, only much worse, issue with a local mortgage company. Seems they filed for bankrupcy and decided to pull all the escrow money for their customer's taxes and took off. Now these people are all liable for their real estate taxes which they have already paid!! Some people owe up to $9000!!!!! Crazy.......
