First lawsuit filed in deadly Sherman wreck

The first lawsuit has been filed in the fiery highway crash that killed 10 people Monday in Sherman.
Maria del Carmen Esparza, wife of crash victim Manuel Esparza, and the couple's six children have sued Miroslav Janusz Jozwiak, 45, who was driving the tractor-trailer that swerved across U.S. 75, striking two vehicles.
The lawsuit, which was announced Friday by the family's attorney, Domingo Garcia of Dallas, seeks $75 million in damages. The family is also suing the trucking company that employed Jozwiak, and the company that employed Esparza, 39, because he was in a company pickup at the time of the accident.
The accident also killed passengers in the pickup: J. Marcos Esparza, 41; Hector Zapata, 33; Joel Mendoza Ruiz, 36; and German Esparza Velazquez, 19.
The victims traveling in the second vehicle were Lisa Wood Martin, 32, her three children -- 4-year-old Chance, 2-year-old Brock and 6-week-old Reid and her mother Betsy Wood, 72.

This is standard procedure, you sue all the insurance companies that are involved. Then when the blame is decided in court, they pay their part as defined by the % of blame assigned them.
For example; Driver 1 80% at fault, Driver 2 15% and Driver 3 5%. If the award if for one million dollars, then each pays their percentage of that award.
Seems kind of crazy to do it that way with some cases, but sometimes there are circumstances we don't yet know that may come into play later on. Equipment might prove faulty as an example.

then sue up to 1% to the beer company who made the beer the driver was drinking while barreling into those cars and killed those people...then maybe 0.5% to the city/county road maintenance crews who cut the grass in the median too short causing the big rig to jack knife and spin it's wheels...
Top said it right. The standard format for a suit is to sue the driver, the owner of the vehicle, the insurance company, the company he worked for and any other parties involved in the legalities of the vehcile. It is not done any other way. The judge sorts it all out.
There is good reason, especially where he was driving a company owned bvehicle. He may have had a bad driving record that should have been addressed by the company and they were neglegent if not addressed.

Don't forget the County, City, And State. If the light had turned yellow 1/2 second sooner, you would have had enough time to bring your vehicle to a stop, before entering the intersection, thereby avoiding the accident.
Well , come to think of it, I may sue Dodge, Cummins, Texaco, Valvoline, and others for my being 20 pounds overweight. If Cummins had not made such a good motor, and put it in a good truck (Dodge), running of off diesel fuel (Texaco) with such a good engine lubricant (Valvoline), I would get my exercise and keep my weight down. Instead, I am addicted to the sound, power, and feel of my truck. So I drive to the mailbox to check the mail instead of making the 1.5 mile walk.

You can thank the Liberals and liberal judges for all of the ridiculus lawsuits. Like sueing a gun manufacturer that made a gun that a guy kills someone with. It's not the gun companies fault that some guy wigged out and shot his neighbor but the liberals see it as a way to help put gun companies out of business and further there cause. Then we can bring the without ACLUe people in and some of their stupidity. It's no wonder insurance and healthcare rates are going up. But some Liberal policitian like Kerry has a plan to make healthcare available for everyone. he will tax the snot out of those of us that work for a living and give our hardearned funds to the welfare class in the form of benefits that they are not willing to work for themselves.

I was not insuinuating that this is a good system or that it is correct. Certainly there needs to be some limits and control on how a suit goes. But this is the way it is done regardless. If someone is seriously injured or killed you can count on a suit. The only thing correct about it is "politically correct."
