Having been with several companies that went through Involuntary severances (layoffs) and discussions with the freinds affected.

What they were told is that if they signed "the paper" and accepted a severance package they were not eligible for un-employment benefits because they were paid a severance. So they may want to pay her a severance payment so that she can not receive the unemployment and have that as a strike against the company.

Who told them they were not eligible? An employer can not tell you that you can not apply for benefits.

Rob,

Even tho she talked to the unemployment office, I would highly suggest that you fork out a couple bucks and go talk to an attorney that specializes in labor law in the state of Texas. Just my .02 Having been an employer for over 10 years now, Ive found thats the best way to deal with labor issues.

Here in Washington I do not believe you would be entitled to unemployment if you sign that paper. I work for an employer that no matter how the employee was terminated be it volantary or not they will and do fight every claim. I have been here 13 years and have only seen 2 people get unemployment. Just because you apply for the bennefits does not mean you will get them. If you sign that paper it just give the company that much more to stand on and not have to pay because it will costthem alot more to pay the unemployment than it will to just pay her the severence. Bottom line is don't trust them and be very careful with what you are signing.

My wife took a voluntary severance from work and was able to get unemployment also here in Texas. She had to sign in order to get the severance. I think you are ok, but I an no lawyer, just passing on what happened with us.

Hope it all works out ok.

Update

Wife signed the letter (mentioned in post 1 of this thread). She got her severance. She later applied for unemployment insurance (UI) and was deemed elligible. She got her first check on Saturday

All the folks who said to call again, or don't sign, and get name of person, phone # and extension, shoe size, IQ, and anything else@! are correct.

The folks who answer the phone only want you off the phone, they get paid whether they give you the correct answer or not! You and your wife have to live with the consequence.

Be extra cautious. The bank wants you to sign the paper for their protection, not yours.

Most lawyers give you the first 1/2 hour meeting without charge. Get informed as if you were preparing to go before the unemployment department---'cause you may be if you sign!!

Show up 10 minutes late and leave 10 minutes early...

I started doing that and my boss started being 15 to 20 minutes late and elaving 15 minutes early.

he just had to one up me...
