home defense
"Criminal codes in many countries include self defense as a legitimate justification for the use of deadly force. On the other hand, the right of self defense threatens the rule of law. It is too easy for revenge or even aggression to be confused with legitimate self defense"
"In Canada, the key provision in the criminal code is that no one may use "more force than is necessary" and then only when "he believes on reasonable grounds that he can not otherwise preserve himself from death or grievous bodily harm." In section 35, the code goes on to require that one must show that, "he declined further conflict and quitted or retreated from it (the assault) as far as it was feasible to do so before the necessity of preserving himself ... arose." Moreover, the right to use physical force to defend non*family members is more limited than it is in many states, as are a Canadians' rights to repulse trespassers on one's own property, or to use force to stop the commission of serious or violent crimes "
Recent firearms legislation now requires firearms to not only be unloaded when stored in one's residence but must also be put under lock and key. Judging from news reports, many of those who use a firearm to defend themselves, are charged with one or more criminal violations ** unsafe storage, careless use of firearm, or possession of a prohibited weapon ** and then they have to prove in court that the firearm had been used in self defense.

I tend to agree with some of this. You can't go start a fight then blow the guy away.......claiming self-defense. Common sense should prevail here.
But if an intruder is breaking into my home to harm me or my family....the SOB is gonna be turned into swiss cheese......and rightly so. I don't pick fights. But I will finish one, if necessary..........and I won't fight fair.
By the way........an unloaded gun or one locked away in a cabinet is of no use to anyone. You may as well not own it. That's like trying to drive a car with no gas.......or drive a nail into a piece of wood with your thumb instead of a hammer.
I won't be moving to Canada anytime soon.
I did plan to pass thru there someday on my way to visit AKTALLPAUL...if he would let me..
..
thats why i have the gaurd dog on duty signs if i had beware of dog and someone gets bit in my yard or house while intruding i am legaly liable. but because i have guard dog on duty i am not go figure...
My brother lives in TX and I live UP HERE. We are always talking about the differences and the illogical way that the Canuck Gov puts laws in place.
I had to head south a few years back when my brother had an encounter with an intruder. He took a 9mil in the left shoulder that bounced off a bone and just missed his heart. His neighbor heard the shot, came running and the perp went down in the yard. Investigation was short and sweet. UP HERE, the neighbor would be in jail with my brother and the perp would be getting all sorts of freebies...and probably television coverage with his 'rights' being the key to his next gain of $ in life.
I believe in protecting whats mine. Thats why I have a [censored] here and there with [censored]

Are you saying Canada won't let you protect yourself with a firearm if you are being attacked by an intruder??????? GEESSSH!!!!
In Texas we now have the "Castle Doctrine" law....that basically says you have no duty to retreat at all. It applies to your vehicle as well. If you are being attacked, robbed, whatever.......blow em away. They deserve it and you can legally give it to them if certain conditions are met. Which is exactly the way it should be........USA, Canada, or wherever, imo.

Yea the laws up here SUCK!!! We have a "neighbor" 5 doors down that cooks & sells meth and deals coke. He has sold to 8 undercover rcmp and city cops, been put away twice in 5 years and the judges keep letting him out because he has 2 kids that he has to support (he does not work, crack head wife looking after kids). I called social services and inquired how someone can cook and sell drugs and have 2 small kids in the house and that is ok, yet if I spank or give my kid a time out, they will take them away. It was pretty quiet on the other end and they said that there are worse cases out there than him cooking and selling to 12 year olds.
the fact that you cant use a gun for self defence is just stupid (to say the least). Years ago when some vice president or someone was trying to get a ban on guns my dad said "the day guns are out lawed, is the day I become an outlaw" and I will be right there beside him if that day ever comes about
The stupid gun laws in Canada make it easier for me to go and buy a restricted handgun than it is to purchase a legal firearm from a gun shop.

I bet my neighbors still wonder why I keep my front lawn well oiled ...

I don't have anything in particular against Canada. I just can't understand that "surrender and hope for the best" mentality. What is it that influences such liberalism there? Im no right wing whacko gun nut. I just believe in being able to defend yourself...........be it against a scumbag, a wild animal, or, if necessary, against my own government....or die trying (when they decide my 2nd amendment rights are going to be infringed upon).

one of the best things to do is look at your property from the thiefs view. walk out and see what they see. make it more desirable to go on down the road to steal . don't leave stuff to steal in front of your window or in cars. i know you are aware of this by the area you live . big dog i love it. i am fencing my forty acres next spring and two big dogs are going to roam it free.

IS THIS THE CHANGE YOU VOTED FOR ??????????????????????

ANY REASONABLE PERSON WOULD THINK SELF DEFENSE IS OK ON YOUR OWN PROPERTY OR IN YOUR HOME OR CAR BUT NOT WITH THESE NUTS !!!
THEY WANT MORE RADICAL CHANGES THAN YOUR OLD BUDDIE SLICK WILLE AND HAVE ENLISTED SOME OF HIS COHERTS TO HELP THEM ALONG .
I THINK ALL STATES HERE SHOULD BE LIKE TEXAS -IN MICHIGAN YOU HAVE TO INVITE THEM INTO A BUILDING FIRST AND NO SHOTS IN THE BACK BUT NO MATTER WHERE YOU ARE MAKE SURE THE JOB IS COMPLETE - A ONE SIDED STORY GOES THROUGH THE COURT SYSTEM QUICKER AND ENDS BETTER IN YOUR FAVOR.
Just a subtle reminder. The gov has the laws UP HERE. However, it does not mean that all of us are little followers.
I think both Canada and the USA would do alot better if more of us would stand up and do something instead of laying down. I know its a lot more pro active south of the border but believe me...not all of us UP HERE are taking this stuff laying down. Maybe its time for that pendulum to swing back where it belongs.
Its not a good idea to tell em what were thinkin...or doin.
Capiche?

Being in Texas I keep my SAXD 40 s&w in arms reach, keep the Benelli 12 gauge next to it. I also have my dogs, they are my full surveillance and alarm and they haven't let me down yet. I have hundreds of false alarms to prove it, mainly possums, snakes and coons. They sleep outside on the other side of the wall to my bedroom, so they snap me awake when its important.
I love my pit bulls, I am aware some of ya'll cant go this route, so there are other suitable guard dogs. I just don't want anyone to come into my house when I'm not there, when I'm there they are pretty mellow towards other people. Keeps the tax man out of my yard too lol
