Much as I believe in defending yourself and your family, I have to agree, shooting him after chasing him a quarter mile is not self-defense.

This may have been posted before but here is another case of a veteran being tried for shooting an intruder.

Doing two tours in Iraq has nothing to do with being able to control your emotions. if anything alot of guy can not control them as well as before going there.

The fact that he was in the Marines has nothing to do with not having fear. He is still a human, the guy isnt untouchable. He will still fear things the same as anyone else, he just will react differantly to them subconsciously

hes lucky he wasn't in cali, your not supposed to shoot someone IN your house. how do they say, better to be judged by 12 than carried by six. 2 years is a easy bid for killing someone running away.

That's why you need a gun with filed down serials.....to put in his hand after you dust him. The judicial system could have used this case for good....but they didn't. If we would start killing people that do these types of things...Trust me the crap would stop!!! Take a look at other countries, there crime rates are low.....Because if you get cought doing bad things you DIE!!!! Not live a better life in prison on someone elses dime.

It's hard to separate out rationally, what is legally self defense and what is ones own idea of self defense. Hard to decide in the heat of the moment what is justified by your own anger and values when it might mean just letting the bad guy run off into the night vs being punished yourself. Do nothing and see injustice, get no closure. Or punish him right then and there, satisfy the anger, and pay a price.

Who wouldn't try to get that guy with every bit of energy they could muster? And yet when you do, where do you stop?

The only thing that might have satisfied both concerns, legal and personal, would have been to chase him down and hold him for the cops. Although that's probably the most dangerous and certainly won't work in every case.

So what are we to do? Sit around with loaded guns pointed out the windows, ready to blast anything that moves? Anxious and paranoid. Or let the bad guys have whatever they want and just shrug it off? Docile, uncaring and not attached to anything. Can we ever have a good peaceful life and not be constantly prepared to fly into action with guns or fists blazing? I hate being always on alert. So much so that I am not, and sometimes I get burned. I also hate a thief or someone threatening to my loved ones, and can go from docile to "in your face" rather quickly if I feel justified. These days it seems society is breaking down and a lot of care must be taken just to avoid problems. That leads to tension and expecting trouble. And that leads to a heavy response to a minor problem. And that leads to a further deterioration of society.

Castle Doctrine says you have the right to shoot anyone with deadly force who is on your property.

in some Northern states, you "have a duty to retreat" which means you are REQUIRED TO LEAVE YOUR HOUSE to the thieves and seek protection.

(yah!! vote for Hillary!!)

I can't see anyone that could say someone running away is a threat.

our CCP instructor told us: " if the bad guys KNOW you have guns, or feel you are a threat, and REALLY want your stuff, they will have one person break a window/door, or be suspicious to lure you outside, then kill you from behind. stay in the house, and if they come in, they will be exposed, and you can shoot them then"

he said IT'S A TRAP to go outside.

this is what worries me - you see one roach, there are a hundred somewhere close by.

would you really want to set up & keep watch for your families safety for the rest of your life, worrying about this guy & some gang coming back?
