Close encounters of the LEO kind.

Pulling up to a Green light which just shifts to Yellow.

1) I can slam the brakes skidding to a stop before the limit line.

2) I can stop strongly and end up in the intersection.

3) I can give it some gas and clear the intersection before it turns red without going more than 5mph over the limit.

I chose option 3 it being the least hazardous IMO on a split second decision.

I pull up to the next light which is RED and stop of course.

While I nodded, nearly napping, suddenly there came a tapping,
As of some one gently rapping, rapping at my passenger door.`
'Tis some Officer,' I muttered, `tapping at my passenger door -
Only this, and nothing more.'

I rolled down the window and the following conversation took place.

Officer: Hey, you know that wide pedal next to the skinny one.

Me: Yes.

Officer: If the light is Yellow, use it.

Me: I debated stopping but felt I'd end up in the intersection.

Officer: It's illegal to accelerate through a Yellow light.

Me: I understand, it was a snap judgment call for me.

Officer: I heard your Turbo spool up and I know the lag time, you floored it.

Me: I'm not denying that, as I said it was a split second choice and I didn't approach any ticket worthy speed.

Officer: Well in the future don't accelerate through a Yellow, another Officer would ticket you.

Me: Understood.

I should have said...

Hey! You listen to me, Mr. Officer. I voted for Jack Thorpe in the America's Most Wanted All-Stars that means I'm unticketable.

Ya, these guys/gals already get enough grief, no need to add to it. I have to admit I was unaware of the accelerating through a yellow can be cited. I gather it's one of those spirit or intent of the law type situations. I wasn't trying to beat the red which in my opinion is what the law is focusing on. I was trying to do the safest thing for the situation.

Acceleration through a yellow is illegal. You are supposed to either stop or maintain a steady speed through the intersection depending on how close you are. Also, 5 mph over the ticket did technically warrant a ticket.

I say, be thankful he just verbally warned you for your poor judgment.

Rule No.1
A yellow light legally means 'Clear the intersection'.

Legally it is enforced as "1.) If you're in the intersection when a yellow light comes on, get out of (clear) the intersection." AND AND AND... "2.) If you're not in the intersection, treat the yellow light as a red light on DO NOT ENTER"

The reason a yellow light violation is enforcable is mainly the second part is what people violate.

If you are way back and the light turns yellow, and you punch the gas 'hoping' to beat the light, you can still be ticketed, EVEN if you do beat the light. You violated part 2.

Now, if you run a yellow, then it turns red, and say you were then stuck in the middle of the intersection because your lane stopped moving and you CANT clear the intersection, you can also be cited for blocking an interseciton.

It is this part (blocking an intersection) that yellow light violation laws are on the books.

The method to the maddness is traffic laws exists to keep you from blocking the intersection, and yellow lights exist to warn you to NOT ENTER the intersection, so it can remain clear.

I am thankful. As far as 5mph over, yes if the officer chose to, he could write me a ticket. What I meant was majority of officers wouldn't issue a citation for 5 over here in California per experience, Aunt (CHP), Grandfather ex-SFPD and retired SFFD, friend WCPD, friend COCO Deputy, neighbor retired OPD.

P.S. You all skipped over the most important part.

He didn't say I heard your engine rev or your obnoxious exhaust...

He said "I heard your turbo spool up"

I was taking one of my commercial driving tests a couple of yrs back and was rolling along at the speed limit with the instructor in the passenger seat. Just as I started to cross the crosswalk line the light turned yellow. I did not change my speed and rolled through. Nothing was mentioned until after the test results where handed to me. He said I did the best thing possible with a big rig in that situation.
It can and will be interpreted in different ways by different folks.

I got pulled over by a Stater the other day for talking on the phone and got a warning.
I was armed, had my dog in the cab and my wallet was in the center console.
I was respectful, followed simple, clear instructions and had no argument as to why he stopped me or lame excuse.
These guys have a hard enough job without me interrupting there shift by getting pulled over for breaking the law.

More power to the good guys.
